Wrong country of chargeability of Spouse in DV Form

Greetings to All,

I am Indian National by Birth, and my Spouse is Russian National and Birth Place of my Spouse is Uzbekistan and behalf of my Spouse I applied DV Lottery and by mistake I chose my Spouse the country of chargeability RUSSIA in the Electronic Diversity Visa Program Form at time of application, which I came to know that latter, when I came to know that I am Selected as Main Applicant.

 

I did mistake and I supposed to chose country of chargeability UZBEKISTAN(as per my Spouse Birth Country) not RUSSIA.

 

Russia and Uzbekistan both fall under Europe.

 

I did the DS-260 Forms for my Spouse and Child(Birth Place: Russia, Russian Passport Holder, Age: 1 Year & 5 Months) and Mentioned all the Correct Information about my Spouse's Birth Place - Uzbekistan and Previous Nationality - Uzbekistan and Current Nationality - Russian.

 

Please suggest & advice as per your past experiences.

Tricky one. The old version of the manual says you can use wrong country of chargeability as long as it’s in the same region as the correct one AND no benefit was obtained by using the wrong one. Although that entire section has dropped from the manual, we know of a couple of cases since where cases like this have been granted visas. The problem is that Uzbekistan is limited in selectees (due to the country quota) so there is potentially a benefit using a different country. No idea whether the consulate will enforce this subtlety. (I know of one case a few years ago where this “benefit” mistake was enforced and the visa denied, but it was at a consulate in Africa.) You’ll have to decide whether it’s worth the risk/money to proceed.
