Hi, Everyone. I am very anxious right now. I am scheduled for k1 visa interview this month. I am divorced in Japan and in the Philippines. However we all know how long it takes to process the papers in the Philippines. I got my Divorce Decree in Japan and I got my Divorce Finality and decision from the Philippines. I requested a CENOMAR yesterday and the marriage is still there and the divorce hasn't reflect to the CENOMAR yet. My question is. Is there anyone here from Japan who is a Filipino that had their K1 interview without having a CENOMAR? I have all the papers from my lawyer including the petition for divorce in the Philippines and its already registered at Local Civil Registrar and the hearing is done by Regional trial court. I am very stress right now I have been processing this paper for almost 3 years! I have spent more than $10,000 in this piece of paper and still nothing. I'm broken hearted right now. Please give me some hope!

Were you married in Japan to a Japanese citizen? And will your K1 interview take place in Japan or the Philippines? 

Yes, I was married to a Japanese we got married in Japan. My K1 interview will be in Japan US embassy.

@Mochiyeah OK, since you're interviewing at the US Embassy in Japan and not the Philippines, according to this page, you just need your Japanese divorce decree: https://jp.usembassy.gov/visas/immigrant-visas/k-checklist/

 

You should be fine.

Thank you I already read this page. They sent me an electronic message asking for these:

 

We are pleased to inform you that the approved I-129F fiancé(e) visa petition filed on your behalf has been received at the US Embassy, Tokyo.   

 

To continue processing your case, we strongly encourage you to mail listed documents below as soon as possible (before your interview). Some of your documents may take several months to obtain as they need to be original. Please make sure all information is legible, complete and accurate.

 

*IMPORTANT*

If the documents are NOT in English, you must attach an English translation. Please attach a photocopy of your original documents if you wish your original documents returned to you.       

         

  1. Original Birth Certificate issued by the PSA office for you
  2. Original divorce decree for you in Japan if any
  3. Original Cenomar issued by the PSA office for you

(Certificate of no marriage/advisory on marriages – the court records do not have to be reflected)

  1. Copy of your residence card (front and back)
  2. Original previous passport(s) if any

(Statement explaining the unavailability of your previous passports, if not available)

  1. DS-160 confirmation page, copy of passport bio page, and two photos for you (for each applicant)

 

 

All your documents you submit will be retained in your file for your visa interview.

@Charlie Brown 302 recently faced a similar dilemma with his fiancée's Korean divorce not being listed on the CEMAR.  It was not a problem because they had all of the proper Korean divorce documents which accounted for the legal ending of the marriage that was still listed on the CEMAR.  I'd be fairly certain a Japanese divorce would be the same.

  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

You must bring your PSA CENOMAR or CEMAR (Advisory on Marriage), whether or not your divorce is already listed there.  As long as you also present your Japanese divorce papers with certified translation, the US embassy will not mind that your CENOMAR/CEMAR has not been annotated yet.  But if you do not present any CENOMAR/CEMAR, you will get a 221g at the interview, so I do not recommend you go to the interview without it.

Thank's everyone. I asked my cousin to get my CENOMAR and she is sending it in Japan. It hasn't reflect the divorce annotation yet but i'm gonna attach the Finality and Decision from the court and proof that it has been already registered at Local Civil Registry. I hope this will work.
