Proof of citizenship

Hi guys, we’re approaching review day (hopefully next week, since we resubmitted April 5th), but question! I people on Facebook that have submitted proof of petitioners citizenship. I haven’t seen that being required anywhere. We haven’t done that, we got a RFE in March requesting only the W2 for 2020. 

like these are the only documents submitted by petitioner. Do you think we are going to get a second RFE for that?

Reading the instructions for the I864EZ, I don't see anywhere that says you need to provide additional proof your, the petitioner's, citizenship.  Since you should have answered "Yes" to 1a, and you already provided proof of citizenship on the I130, you should be fine.

The FB group you heard this from may have been referring to this section in the I864 instructions relative to a joint sponsor.  As you see, this specifically says proof of citizenship is not necessary if already provided with a petition such as the I130 or I129F.

Item Numbers 11.a. - 11.c. Citizenship or Residency. You must provide proof that you are a U.S. citizen, U.S. national, or lawful permanent resident for joint and substitute sponsors and for relatives of employment-based immigrants who file Form I-864. Petitioning relatives who have already filed proof of their citizenship or immigration status with Form I-129F, Form I-130, Form I-600, or Form I-600A do not need to submit proof of their status with this affidavit.

 

1. Proof of U.S. citizen or U.S. national status includes a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to U.S. citizen parents, or a copy of the biographic data page of your U.S. passport.

 

2. Proof of lawful permanent resident status includes a photocopy of both sides of the Permanent Resident Card or Alien Registration Receipt Card (Form I-551), or a photocopy of an unexpired temporary Form I-551 stamp in either a foreign passport or DHS Form I-94 Arrival-Departure Record.

 

3. If applicable, also provide the sponsor’s A-Number in Item Number 12.

Proof of petitioner's citizenship is not required. We didn't upload it and got DQ'd.

yeah i don't believe it is a requirement. Hopefully DQ for you soon!! keep us updated  😁
