Affidavit of support and medical exam

I was attempting to post this in the Philippines column but I couldn’t figure out how to do that so I will do it here. My fiancée is in the Philippines and we are working on the k1 process. 2 questions and I ask this here because I’m not sure if my lawyer is correct. The secretary just sent me an email stating that my fiancée did not need to do the medical unless the Manila consulate officer deemed it necessary and she would have to do the medical once she applied for adjustment of status here in the states. Is this the actual case? I’m concerned about where my lawyers secretary is getting this information. Also I am confused about the affidavit of support. Once again my lawyers secretary is stating that I don’t do the affidavit of support until the adjustment of status. But there is the form i134 that needs to be done for the Manila consulate interview. I’m hoping someone can tell me what the actual case is. She is now saying that my fiancée and I can go ahead and schedule the k1 visa interview and as I mentioned earlier, don’t have to do the medical exam unless the consulate officer deems it necessary. I hope someone can tell me what I really need to do.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

False.  All K1 visa applicants in the Philippines are required to go through medical exam at SLEC Manila.  If your fiancee does not have her medical prior to interview, she will not be allowed to interview at USEM.  Also, K1 visa holders who complete their visa medical (with all required vaccinations) within 1 year of filing I-485 for adjustment of status are NOT required to repeat the medical in the US.  That secretary is spouting BS.

Wrong again.  I-134 is required for the K1 visa interview, although some consul officers may not ask to see it.  Don't risk it.  Make sure your fiancee brings an I-134 from you to her interview.

Again, the medical is absolutely required prior to the interview.  But you may schedule the visa interview already if the K1 case status on CEAC is "Ready".  Just make sure that your fiancee completes her medical before her interview date.

Not a newbie but lost my old info years ago) I have been through this process before --all the way through naturalization-- This site has always been a great help to me.

I was just typing my response and I accidentally erased it so I will make the retype brief. After emailing my lawyers secretary, she left a message stating that she did indeed make a mistake about what she said. She got confused after reading different forums about these issues. She told me to schedule the interview, which I did and then she will schedule the medical exam. My fiancée interview is in about 4 weeks and I emailed the secretary already. She will let me know when the medical exam is and go from there. She said she was indeed wrong about the medical exam and she apologized for the confusion.

I am glad that you got things straightened out. I would be concerned that the lawyers secretary is relying on reading forums to process your case. I would check the scheduling of the medical myself.
