Hi again. I wanted to ask as a petitioner what other additional documents I have to add? I added recent pay stub, certificate of employment Do I need to upload birth certificate,  divorce decree, marriage certificate? I already uploaded marriage certificate for applicant documents and divorce decree before even reaching  NVC. Do I still need to add these or is it too exaggerated. 🤔

You should add at least the last year of your tax transcripts (available from IRS account), probably more years if you have them. The other stuff should have been uploaded in other sections so not needed for Affidavit of Support.

I uploaded exemption letter of fed tax, with cert. Employment and a pay stub.

 

Is that I saw in the listing of documents, birth certificate, divorce decree and marriage cert. So adding these in AOS additional will be too much then. Thanks

Can I add more pay stubs from the last 6 months. Will it reset my case to day 1 if I upload more. I only uploaded 1 pay stub with a  certification of employment.

Hi, I submitted all documents on February 12, but I see that there is Petitioner's birth certificate, marrige and divorce. Do I need to upload thr birth certificate even being a US citizen? Do I have to upload divorce decree and marriage certificate. The marriage cert. Is already on the applicant.

 

If I upload these documents, will it reset my wait time?

Birth certificate or US passport is proof of US citizen

Divorce decree is required, every filing all the way to N-400, over and over.

Marriage certificate is proof of eligibility for beneficiary, has to be submitted.

No idea if it resets wait time.  We always submitted exactly what was asked, when it was asked.

Hi and thanks. The marriage certificate is already submitted  on thr applicant documents. I wss asking about petitioner's documents i864 AOS. Why the divorce decree? On the i864 AOS? Im still on time to upload more documents.

I found that info under applicant in Department of State and not for petitioner's. My part is income i864. I did add the passport page just in case and I wanted to make sure that for NVC they also wanted my marriage decree even if USCIS already asked for that on the form.. for previous marriages. NVC doesn't ask the petitioner's prior marriages. That is why I get confused.

You need to submit all that is requested. Will it reset wait time when you submit ? Not sure that is the right question. You definitely will slow down the process by not submitting everything.

Read the instruction sheets from USCIS for the specific form YOU are doing each time. Think of each form as a separate item. Submit the required documentation for each form, no matter if that document has been submitted already for another form.

Firstly the assessmemt of all documents is delayed until all documents are submitted 

 

Secondly, if a document is asked for then it is required… if it is not asked for .. or stated as “may be submitted”, then it is not needed.

Thanks. I uploaded petitioner's birth certificate, passport for proof of citizenship, divorce decree even if it wss not required.  Im guessing that uploading more documents even if not needed won't harm my petition. Thanks for your help. I have that feeling that since USCIS has my divorce sentence, they'll also ask for that document too. As for today, now Im sure I submitted all additional documents.

Marriage / divorce decrees were needed for our:  I130, I129F, AOS, ROC, DCF, SB1, and N400 and for every single interview associated with these convoluted filings.  Originals and copies were brought to interview.

 

We do not know if timing is reset or not.  Missing documents cause delay for sure.  If USCIS asked for it there is a high possibility the CO will want to see an original of it.  Exception:  US citizenship docs.  They checked you before your file left the desk and moved on.  Proof of marriage validity?  Marriage certificate and proof of legal divorce?  They run their finger over the court seal LOL

 

Affidavit of Support does not require a divorce decree, it is part of the proof of legal marriage that is the basis for the immigration benefit.

I was in the AOS for Affidavit od support and there is a tab that has divorce decree. Anyway, I already uploaded it even if not needed. Im in the NVC documents. Im done with all documents needed, now let them decide what they want. Im dont have to go to the interview, only the applicant my wife; she will have to take her original documents and copy to the embassy. Im still sending her my pay stubs and evidence.
