Won DV Lottery while IR1 i-130 Petition Pending

Hi,

It would be great if someone could help me out to understand my current situation. I am one of the winners of DV2022, but i had my i130 petition pending at that time. So, i went along with the DV process and submitted the DS260. Recently, my i130 petition got approved and is forwarded to NVC for further processing. I am in a dilemma. I am at the final stages of my DV process.....waiting for an interview date. Unfortunately, DV cases in Nepal is not moving forward as it used to...not even a single interview has been scheduled. Is it possible to have two DS260 filed at the same time ? Will it affect me in any bad way ? Is DV winning considered as another petition ? What would you recommend ? Please advise. Thank you.

An approved I-130 petition has no expiration date.  It has an I-864 requirement, evidence of bonafide marriage requirement, and depending on the length of the marriage an I-751 removal of conditions requirement.  
 

If the DV visa interviews are happening, I would try that first.

Those who do not obtain their diversity visas before the end of the fiscal year will lose their spots. With a less than 1% chance of being selected in the visa lottery, not obtaining the visa in time means they most likely will have lost a once-in-a-lifetime opportunity.
