Hello,

 

My wife and I submitted the paperwork for her AOS in the beginning of May. The service center is Texas Service Center as she is in removal proceedings due to a denied asylum. I don't know if this context matters.

 

USCIS online shows that her biometrics were re-used, and we received a letter saying they were re-used. This was in mid May.

 

Today we received a letter from USCIS with an appointment for biometrics.

 

Of course, we are going! We were just wondering if this is just bureaucracy gone wrong or if something else can cause this?

Just sharing this in case anyone has knowledge in this type of situation and can enlighten me.

 

I married my wife when she was already in removal proceedings. She came to the US with a tourist visa, requested asylum. She was referred to the court from the asylum interview. After marriage, Our I-130 was approved one year without an interview. We submitted the I-485 to both the court and USCIS in the beginning of May.

 

We received the USCIS saying that her biometrics were re-used and there wasn't going to be a need for a biometrics appoint on May 13th 2021. The case status online showed as much: Biometrics applied on May 13th 2021.

 

A few months later we received a biometrics appointment for September for the I-485 anyways, sent to my wife's name and also C/O EOIR I-485 , as far as I know, that's the court system. We went to the appointment and now the case is showing biometrics applied but with the new September date.

 

I am not sure if there has been movement on the court side, or why that biometrics appointment was sent. The case hasn't been dismissed nor a new hearing date has been assigned.  The immigration court is in Orlando, FL.

 

I'm very curious what the C/O EOIR I-485 means, as the other letters do not have that.

Hello,

 

We just received the unexpected biometrics appointment. Our lawyer hasn't heard anything from the court, yet. My wife and I were just curious (well mostly hoping) that the C/O EOIR I-485 part means we will hear something from them soon.

EOIR is Executive Office for Immigration Review

if your lawyer didn't know this,  he is not a  good one

My lawyer knows who they are. He just doesn't know why a new biometrics appointment was requested. I am just curious why a new biometrics appointment was sent after the case showed for months that biometrics were applied. That is all.

just to check and recheck the ID of the applicant

Adil was checked every time we did a form

Ah ok. I was hoping it was a sign of an update to come: hearing date, case dismissed or something! lol

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
