Guys - I am at the following state now:

 

GC EAD secured.
EB2 to EB3 downgrade of I140 - pending with USCIS.
I485 applied on Oct 28 2020

 


I want to move to my client company but they’re saying they won’t sponsor my Visa. May I ask someone to help what should I do? Am I eligible to move without I40 getting approved by USCIS? what are the implications?

 

 

Does the company that wants to hire me need to sponsor anything at all (PERM or I140) ?

It's considered inadvisable to switch employers while your I-140 is still pending. If an RFE is issued on the pending I-140, and you are no longer with the employer that filed it, they may determine that it's a waste of time and money to respond to the RFE. The I-140 would end up denied and the I-485 along with it.

Like the other poster said, it's very risky to move right now. Your i140 has not been approved yet. Also, I don't see why you'd move to a company that would not support you with this. If they aren't supportive with your GC like your current company, most likely they won't be supportive with other immigration issues that could come up. Right now you are in a precarious position.

what would you do if i-140 is denied or an RFE arrives at your previous employer after you leave them ? 

 

you can switch once i-485 is filed but the petition belongs to your previous employer and they can just choose to not respond to USCIS . wait for i-140 approval and i-485 pending for 6 months after filing
