Timeline

 

 

 

My son was invited for an enterview in December 2019 only to be told that his visa category has changed because l am a citizen now  . I was a green card holder when I filed for him but got my citizenship six months to his interview.

So his status of F2b is now F1.

My question is  

what is his priority date now?

Is it 2014 or 2019?

I need help.

The PD is your i130 receipt date. If it was current under F2B at that time, you could have retained F2b and not switch to F1 so that you son didn't need to wait for another interview this long. Anyway i believe even your PD under F1 is current as well by this time?

Sorry Adwoa. Your son could have retained his original F2B status if it would have benefited him in terms of timing. He could have done this by writing to DHS (USCIS) to opt-out of the automatic conversion to the F1 preference category upon your naturalization.

Nonetheless, your priority date is still the same one from 2014. 

If the priority date is before 01NOV2014, then he's current again based on F1.
