Question about bringing my brother

? Do you mean the act has been in place since 2002? Yes but that’s not relevant to the calculation, neither is COVID. CSPA is law. The only question is whether or not the calculation will help your brother and that is totally unknowable at this time as you don’t even know when you’ll be able to file for your mother, much less when she will be able to file for your brother, or what the status of the F2A wait list vs annual quotas (determines whether all priority dates current or not) will be.

 

Some free advice from someone whose family has been through 3 N400s in the past couple of years and has spent way too much time on the n400 threads: the uscis processing times page is a lot more accurate than the “personalized” time on myuscis. You can probably expect an interview in the last quarter of the year.

You do not understand.

 

CSPA being around since 2002 is irrelevant.  COIVD will not change CSPA.

Here's a scenario where your brother would age out of the F2a category into the F2b category and would have to wait 7 years for your mom to petition him.


You get US citizenship in November 2021. 

You petition for your mother in November 2021.  Because of the backlog in IR5 cases because of Trump's ban and COVID, she gets her green card in November 2023.

As an LPR, your mother files for your brother in the F2a category, LPR petitioning for an unmarried child under 21.  Your brother is 19 years old.
Your brother's I-130 gets approved in 6 months.  Under CSPA, he gets six months extra after turning 21.  
Because of Trump's ban and COVID, there is a backlog in the F2a category, the category is no longer current.  Your brother's PD does not become current for 2 years and 7 months when he is 21 years and 7 months.  Your brother would age out into the F2b category where the wait would be around 7 years.

There is absolutely no way to predict the future.  No way to calculate how the current Priority Date will change.  No way to know how long it will take USCIS to approve your brother's I-130.  No way to know how long it will take your mother to get a green card.  To many variables that are unknown.

The only thing you can do is file as quickly as possible and hope for the best.
