I'm a Canadian citizen with bipolar 1 and a history of hospitalizations, with no suicide attempts, no history of self-harm. I'm currently stable and on the right medication. I plan on moving to the US after marrying my American boyfriend, however I read that having a mood disorder/mental illness can make you inadmissible for a green card. Does anyone know of anyone with a mental illness and a history of hospitalizations who has successfully entered the US on a k-1 visa? Any help would be appreciated. Thanks.

Only if there is also history of harmful behavior associated with it and the harmful behavior is likely to recur. https://www.cdc.gov/immigrantrefugeehealth/exams/ti/civil/mental-civil-technical-instructions.html

The Immigration and Nationality Act (INA) provides three grounds of inadmissibility related to substance addiction or abuse, or physical or mental disorders that affect behavior. They are –

  • Current physical or mental disorder with associated harmful behavior.
  • Past physical or mental disorder with associated harmful behavior if the harmful behavior is likely to recur or to lead to other harmful behavior in the future.
  • Drug (substance) abuse or addiction (medically called dependence). Dependence on or abuse of any of the substances listed in Section 202 of the Controlled Substances Act (Appendix C). (The term addiction corresponds with the medical term dependence).

If you plan to move to the US "after" marrying your boyfriend, the K1 is not the route to take. 

 

That aside, the main point I would make is that there's no reason to panic before you are found inadmissible. It's worthwhile going through the process and trying, rather than saying "no let's not attempt it because there's a chance I could get denied". In every single application there's a chance that it will be denied. Your chances might be higher than another person's but that doesn't mean it will be a hard no.

 

The best thing you can do is being truthful and honest - not trying to hide your mental illness history if asked about it. Making sure your fiancé is aware and knows everything about it. The greater chances are that you will be fine, and that this will likely be covered by the medical segment of the process.

I am diagnosed bipolar 1 with a history of hospitalizations, currently stable and on the right medication. What do I have to submit for my medical exam in the psychiatry section? Is an extensive letter from my psychiatrist/GP detailing my diagnosis, treatment, and prognosis enough or do I have to submit the full discharge notes from my hospitalizations/notes from appointments too? How detailed do I have to be when addressing my mental illness? Thanks
