married USC yesterday and want to file AOS

i am male 27 on valid B2 and married to USC yesterday now i want to file for adjustment of status . need every body help.i have started filling out I- 485.

First of all which box should i check on page 1, of I- 485 ( part 2 application)

i would be really thankful if somebody look at application i 485 and help me in filling form.

Let me tell again i am on valid b2 visa ( I-94 expiring in june)

if some body need any other info let me know please?

I am applying for an adjustment to permanent resident status because:

a.an immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

The I-130 is the immigrant petition which is being filed concurrently, and if it is approved (which it most likely will) will make a visa number immediately available to you. As the spouse of a USC, you're an immediate relative.

Finally I think you have actually asked the question where it can be answered but you left off:

I may be wrong but that is the only box you can check. You do not fall into any of the other categories.

From what I understand you you can't adjust status from visitor to permanent resident. Now that you have married it is the I130 that will qualify you to adjust based on the marriage. I think you should check " other " and a brief explanation of what you are doing.

You need to be a little careful here also. Your marriage was a little quick. You will need to prove that you did not come here with marriage intent.

I am sure you will get more answers now that you have worded the question better.

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

sjoefl01, I'm so sorry. I know I appear to be following you round at the moment and it's not the case!

It is possible to adjust from visitor status, and it's very dependant upon your intent upon entry. Using a tourist visa to circumvent the K visa requirements is visa fraud, however entering as a visitor and then undergoing a change of status is perfectly legal.

You are correct that the I-130 is what qualifies you to adjust - it is an immediate relative petition. As I said in the post above that puts Ans into category A, because of this:

Attach a copy of the ... relative ... petition filed with this application that will give you an immediately available visa number, if approved.

It is also worth being aware that you may be asked to prove that you did not have immigrant intent on entry, but in order to get a B2 you have to show pretty significant ties and admission through POE was granted. Ans, you haven't given us much about your date of entry, but judging on a 6-month B2 entry granted, I make it that you entered in January sometime. It's not that soon to marry in late March!

It looks very similar to the posts a few days ago where they were already married when he entered on a B2 to take an exam. That poster didn't like our answers. Hmmmm .... this poster just joined 2 days ago. Is this just another fraud? Why is he in such a hurry to AOS on the day after his wedding? Shouldn't they be enjoying a few days together before worrying about this if they are "newlyweds" ?

If I'm wrong, then forgive this post.

It is okay,

We did a K1 and so far it has been pretty straight forward. I meant to give the OP a high degree of uncertainty. I only know what I have read here about other conditions. I have been watching this post for a little while and I was having a hard time getting the actual question. When I finally understood what was asked I gave the best info based on VJ advice I had read over time.

I really feel sorry for people that post questions here and don't get answers. I have been there ( New Orleans office). If I am interested and the OP doesn't seem to be getting answers I reply. This will move them to the top of the list and hopefully somebody ( like you ) will chime in and help them.

This is a forum. You are free to contradict anybody ( including me ). That is the intent of a forum! You get advice based on a consensus. It is " life " by comittee!!!
