Hello everyone,

 

I can't believe it is that time already... I am prepping to file my i-751 with my spouse. I am wondering what the entire process entails? What happens after I file and is there another interview we will have to attend?

First I would start by fully reading the guide (see link below).  You will have to fill out the I751 and gather evidence of your marital union and submit the entire package within your 90 day window.  Once you file you will get a NOA extending your proof of LPR status for 18 months (commonly referred to as an “extension letter”).  You may or may not be required to have an interview when that time come.

You file a i751 within 90 days of expiration of the conditional green card.

 

The green card holder is the petitioner and beneficiary (USA spouse just signs as spouse) Go to the USCIS web page download the current i751 form and instructions

 

You collect evidence of a bona fide marriage, evidence that you live together and you commingle finances. (Joint taxes, joint lease, joint bank accounts, W2, common address on mail and state IDs, joint bills, birth records of childen together, pictures together, travel together….)

 

You may be required to have a 2nd interview together with your spouse, or you may not. Most i751 cases have the interviews waived; it depends on many factors, the quality of evidence submitted, have you been interviewed together before by USCIS, and where the green card holder is from.

 

If for some reason you can not do a joint i751 petition with your spouse you can file a i751 waiver case if you are devorse, are subject to abuse, or become widowed. Must still provide good faith marriage proof between wedding and separation.

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022
