Form DS-5540 / Health Insurance

I’ve read some recent topics about the new DS-5540 form and how it’s apparently not needed at this time.

 

If that’s correct, is there any need for me to buy health insurance for my wife (the visa applicant) before we start the NVC phase?

 

We are young and healthy, so we’d rather not buy health insurance at this time unless it’s required.

 Accidents, sudden illnesses, etc. can strike at a moment's notice.  Everyone in the US needs health insurance, imho.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What will you do if she gets COVID, or appendicitis, or is in a car accident?   Doesn't take much to rack up hundreds of thousands of dollars in medical expenses here in the US.  Much cheaper to pay the premiums.

The CO can still ask about health insurance if the interview is after ~ Feb. 14: https://www.aila.org/advo-media/issues/all/healthcare-insurance-proclamation "On December 31, 2020, the Ninth Circuit reversed the district court injunction of the Healthcare Proclamation (PP 9945) in the Doe, et al., v. Trump, et al., litigation, finding that the proclamation was within the president’s executive authority. Even with this decision, the injunction will remain in place until the mandate issues (approximately 45 days from December 31, 2020)."

 

After entry to the US with the IV, could still sign up for ACA subsidies if eligible. PP 9945 is specifically about US entry.

No. The DOS public charge rule and associated Form DS-5540 are still indefinitely blocked by a SDNY injunction: https://travel.state.gov/content/travel/en/News/visas-news/update-on-public-charge.html "Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire."

Presidential Proclamation 9945 remains enjoined at this time based upon two separate challenges to the Proclamation. In Doe v. Trump, the District Court enjoined the enforcement of the Proclamation. Although the Ninth Circuit issued a decision to stay this injunction (and permit the enforcement of the Proclamation), the Court has not issued a mandate to implement its decision. This leaves in place the lower court’s injunction, pending the plaintiffs’ motion for rehearing en banc which will delay the mandate until the court decides whether to rehear the case. Proclamation 9945 also remains enjoined because the Federal District Court in New York, in Make the Road NY et al. v. Pompeo, issued a separate injunction against the Proclamation as well as DOS’ version of the public charge rule. That injunction remains in place.
