Dual Citizenship Ukraine and US - Pitfalls?

So, couldn't figure out how to place this on the Ukraine forum, sorry.  

Dual Citizen of US and Ukraine, planning to relocate there in 2022 and occasionally travel to the US.  Since dual Citizenship is forbidden in Ukraine, which passport should I use to travel to Ukraine from the US?  Furthermore, after I am in country and choose to travel to the US, which passport should I use?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

When you check-in for your flight in the US, use your US Passport.  Once you depart the US, if you have a connecting flight, use your Ukraine International Passport.  When you enter Ukraine and go through Ukraine Passport Control, use your Ukraine International Passport. 

 

When you check-in for your flight departing Ukraine for the US, use your US Passport.  As you go through Ukraine Passport Control, use your Ukraine International Passport.  Once you depart Ukraine, if you have a connecting flight to the US, use your US Passport.   When you arrive in the US and go through Customs & Border Patrol, use your US Passport.

If you are transiting through Canada (US to Ukraine):  When you check-in for your flight in the US, use your US Passport.  Once you enter Canada, you will need to go through Canada Customs.  Use your US Passport going through Canada Customs.  When you check-in at the gate for your flight departing Canada, use your Ukraine International Passport.  If you have another connecting flight (Amsterdam for example), use your Ukraine International Passport.  When you enter Ukraine and go through Ukraine Passport Control, use your Ukraine International Passport.

Is your last name the same on both, US and UA passports?...

 

If so - then use US passport to leave and enter the US, and use Ukrainian passport to enter and leave Ukraine. That's what I do. But again - my name is the same on both documents.

I should also note as a dual citizen myself (and I heard this straight from the Ukrainian consul in Washington while getting my Ukrainian passport with their direct knowledge that I'm a US citizen), there is no actual law stating that dual citizenship is not allowed. It only states that any Ukrainian citizen that acquires the citizenship of another country is still only a Ukrainian citizen until such a time that they renounce their citizenship within a 2 year period following you getting the second citizenship; it doesn't indicate what happens if you don't do so within 2 years. And he also told me that there's no well-defined way for Ukrainian citizens to renounce their citizenship, except for the President to do so for you under a declaration before congress (as you may know he's done for various more famous individuals).

 

From a legal point of view, just know that you're not violating any laws. All it means is that when you're in Ukraine, you are subject to the full legal codex that all Ukrainian citizens are subject to and not the ones for a foreign national in Ukraine.

 

I've entered Ukraine using either my US or Ukrainian passport and have not heard a word from the on-duty officer about it one way or the other. It's just in your interest to enter on your Ukrainian passport because you can stay longer than 3 months, should you so choose.
