Hello all,

 

My parents were issued IR-5 visa in February, 2020. Little after they got their visa, the flights were banned from India to USA and Trump administration has suspended this category until March 31st, 2021. Their visas are already expired last year. Do they have to reapply their visa and start the procedure again? I as a petitioner have to apply for them starting from the scratch?

 

Any additional info is welcomed. 

 

Your advise will be greatly appreciated.

If their issued visas have expired, they should contact the issuing consulate and request the visas to be re-issued.  It will likely require another medical exam (and possibly more).  The consulate has the option to re-issue or not.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I have read that Biden has not lifted that ban....yet.

This is from CNN.com as of this morning. He is going to pass something on immigration on 01/29. Finger crossed.

 

Biden's focus today will be economic relief

The Biden administration has an ambitious slate of actions for the first 10 days in office, many of which will roll back key policies established by former President Trump.

Each day through the end of the month, with the exception of this weekend, will center around a specific theme, with a set of corresponding actions and directives, according to a draft of a calendar document sent to administration allies and viewed by CNN.  

Yesterday's theme was coronavirus, and the theme today is "Economic Relief." Two executive order are expected. One directs agency action on Medicaid, Pell grants, SNAP benefits, and unemployment insurance.

The second executive order will restore collective bargaining rights to federal employees and initiates action to roll back Trump’s Schedule F executive order, which gave the United States Office of Management and Budget and federal agencies leeway to reclassify key roles.

Here's a look at the rest of the themes Biden will tackle this month:

If they already had visas before the ban they are not subject to it.

 

The visas will be reissued, however, India is not yet reissuing  expired visas as far as i understand. The appropriate thing to do is contact the embassy to find out the embassy specific procedure about how to apply for reissuance (some require specific reasons as to why the visas expired unused). Note that when this is done, they will need to pay visa fees and do medicals again.

My mother had her reissue visa interview today. Ukrainian embassy. I contacted the embassy a few days after the ban was lifted by Biden.

03/31/2014 I mailed applications to Chicago lockbox
04/02/2014 Package received by USCIS
04/10/2014 E-notification paperwork received
04/10/2014 Checks cashed
04/14/2014 Hard notice received in a mail
04/18/2014 Biometrics app letter received for 05/12/2014
04/24/2014 Walk-in biometrics done at Port Chester, NY office( no problems at all, very nice people)
04/29/2014 My status online changed to Request for evidence
05/03/2014 got RFE and now status is stuck on Request for evidence response review.
08/26/2014 Status changed to Testing and Interview
08/29/2014 Got an email update interview scheduled for October 1st and paper notice sent out
10/1/2014 HAd our interview at Hartford,CT office. wasnt approved on the spot. 10/3/2014 Got an update that status of I485 changed to Card Production. Then at night changed to Decision. I 130 Post decision activity
10/09/2014 Status changed to Card production We mailed you a new card. You'll receive within 30 days
10/09/2014 Got a tracking number. Estimated delivery 10/11/2014
10/11/2014 Green card in hand!
Whole process took 6 month( thanks to RFE) :)

I-751 Removal of Conditions

9/16/2016 Package sent to USCIS Vermont

9/22/2016 Check cashed

9/24/2016 Notice of Action in the mail dated 9/20/2016

10/2/2016 Received a letter for Biometrics for 10/19/2016

10/14/2016 Early walk-in for biometrics in Port Chester, NY again like last time no problems
