Hello VJers :)

My aunt has a 10 yr visa valid for multiple entries. She came to the US a couple months ago, and only intended to stay 6 months, so that's what the immigration officer stamped in her passport. She would now like to stay an extra 2 months. I believe she can have her visa extended up to 1 yr on the same visit. How do I go about in helping her. Do we just make an infopass? Do we go somewhere else? I heard about lots of people doing this, just never paid attention, until i need the info myself now. :wacko:

Hmm, I heard you just get a new stamped date. That its not a mail out & see type of thing. Do you have any idea how long this takes to process?

Q: How do I apply to extend the period of time that I am allowed to stay in the United States or change my current visa classification in the United States?

A: If you wish to extend your authorized period of stay in the United States or change your nonimmigrant status (visa classification), you will need to file an Application to Extend /Change Nonimmigrant Status (I-539 Form) with USCIS. You will be asked to submit your original I-94 Form upon filing the application.

The authorized stay is the expire date on the I-94 card.

Since tourist visa's expire relatively soon, how long does this processing take?

If she stays to wait for resolution of this form, and then is out of status, they will void her 10yr visa?

I did see someone dealing with this at the Buffalo office while we were there for biometrics 2 weeks ago, not sure of the resolution though.

Perhaps do an info pass and see if they can extend it there for you.

What difference does it make why she wants to extend it? She wants 2 more months, not a yr or anything. She has a 10yr mutli visit visa, so she definitely wants to visit more regularly

WOA... chill.. the poster was only making a comment.. .. ..

I agree.. why does she want to remain... and YES IT DOES MATTER. It is the burdon of the holder of the visa to prove that extension is warrented. She will need to prove to the Gvmt not us.. If reason for staying is frivoulous they may not allow.. have a good reason.. have documentation and submit..

How to extend stay

"If you want to extend your stay in the United States, then you must ask for permission from the US Citizenship and Immigration Services (USCIS) before your authorized stay expires. Proof that you are willing to obey U.S. immigration laws will be important if you want to travel to the United States as an immigrant or nonimmigrant in the future"

I states that you should apply for extension between 4 to 6 weeks before the I-94 expires.

She doesn't want to extend her visa. She wants to extend her stay in the USA - something entirely different from the visa.

As YuAndDan explained, she submits a form I-539 to request the extension.

I makes a big difference - the USCIS is not going to approve the I-539 application to extend the stay unless she provides a good reason why she wants the extension, and also a convincing reason why she will leave at the end of the extended period.

Read the application and its' instructions.

Well others have chipped in.

Best not to shoot the meesenger.

Get it wrong and she will not have a Visa, it will be an ex visa, it will be no more.

And the chances of another one will be limited.

Assuming succesful, an 8 month prior entrant would be advised to wait quite a while before seeking re-admission.

Yodrak, I did an infopass appointment to find out the scoop on this. The immigration officer said that she wants to EXTEND HER VISA in order to extend her stay. If she extends her stay without extending the visa, she would be illegal.

Point #2, they said that since she only wants 2 more months (and this is totally within the limits of the 1 yr max) the reason she should put down is "continue visiting with family during summer season". I had a bulgarian guy in back of me in line, that heard my conversation, and he said that's the same thing he put down when his sister visited last summer, and she requested much longer (6 months) and was approved quickly. So I guess you don't have to provide a ton of proof of why you want to stay, as long as you are not intending to overstay your visa and your situation demonstrates that.

Look up the definition of a visa.

I had a bulgarian guy in back of me in line, that heard my conversation, and he said that's the same thing he put down when his sister visited last summer, and she requested much longer (6 months) and was approved quickly. So I guess you don't have to provide a ton of proof of why you want to stay, as long as you are not intending to overstay your visa and your situation demonstrates that.

You used Visa again.

I have seen people who have got them easily, and those who have not.

To state the obvious, the person you spoke to is not the one who will make the call. And also has no obligation to provide you with correct legal advice. See a lawyer if you want that.

Extend the visa is not the right term. Since the visa is valid for 10 years you cannot extend it to 10 years and 2 months. You need to extend the stay from 6 months to 8 months.

If approved or denied in anycase please do let us know of the results. It will help others who are looking into doing the same for extended family visiting the US.
