RFE I-485 - I-944 Needed now?

mine was before December, in November 2020. Yeah NJ is a plaintiff in the case related to the preliminary injunction granted on December 2nd that blocks the new public charge rule, but because that's not a final decision yet, it's still very uncertain, the dhs can appeal still, so unless a final decision comes along, i'm gonna have to file the i-944 😕

I was asking to potentially see how USCIS has reacted behind-the-scenes to the Dec. 2 decision. In the past few weeks since the decision I've only heard about I-944 RFE for applicants in non-Plaintiff states (e.g. Florida, New York, Tennessee, etc.). There's still no official update on uscis.gov about Dec. 2 decicion: https://www.uscis.gov/news/all-news

I know right? That's what I wonder too. I have googled the heck out of this since I learned about the injunction of Dec. 2, to see if anybody knows anything about this whole mess and I even tried to call USCIS, but no success. USCIS keeps hanging up on me when I keep asking the bot to let me talk to a representative. 

 

Basically, it seems that the DHS have 45 days to counter appeal this decision and I guess in the meantime USCIS will just pretend nothing happened lol while everyone in my situation has to stress and shed a lot of money to obtain the pile of documents and evidence that the form i-944 requires anyway.

Thats why i was surprise, I received my RFE last month and two days ago we received the appointment for biometrics for my wife and son. So I'm not sure, wouldn't the case be on hold until i-944 is filled out and sent out. Also my son never received his RFE for i-944 request.

Are you in one of the plaintiff states (re: the preliminary injunction of dec. 02) ?

Indeed you are in one of the plaintiff states! So you got the biometrics appointment for the upcoming interview even though you got the RFE for the form i-944...that gives me hope!!

yes hopefully they just toss my i944 form out lol and move on with my case. as i stated earlier i just sent it this week.

Spoke too soon!! My 6 year old got his RFE for i-944 lmao He said he wants to add his toy car and transformer as an asset.

Biometrics are mainly for background check, it's not necessarily tied to the interview. Before covid it was common to have biometrics within the first month after applying.

a background check after you already in the states? I mean what was the point of her K1 Visa paperwork? you would think they would want to make sure they know of your background before stepping into the country and staying.
