Is there a chance to get the removal approved without his support?

Yes there is. Secure all the evidence you submitted to show the marriage was bonified, you will need that. then change to a divorce waiver, lots have people have done that and can guide you along. 1st step is to relax and approach this in a positive manner. you dont need your husbands support to remove conditions but you do need the evidence of bonified marriage. work on that for now.

Thank you.

I already submitted evidence when I applied in April for removal:

Life insurance with my name in it

health insurance with both our names

2 lease arguments that have both our names

2 neutralized document of people saying that we lived and we are living together

I still have more evidence

You will need to convert your i751 from a joint i751 application to an i751 divorce waver case. You can do that by mailing a letter to the USCIS service center handling your case, or if you are call to an interview go by yourself to the interview and convert your case with the USCIS officer in person.

The only thing you will need is a divorce as soon as you can. Your spouse can not keep you from getting your 10 year green card on your own with a divorce.

The proof submitted already is good and you will need that to prove your bonified marriage, secure a copy of it. That along with a divorce is all you need to get the conditions lifted from your green card.

good luck.

I came with a fiancé visa , I had my green card of 2 years
I applied for removal of conditions on April

get a letter of extension for 18 months

my husband want withdraw his sponsorship and file for divorce

what should I do

please help me

Since you already have the green card, your soon-to-be-ex cannot withdraw his sponsorship. He's in it for another several years. But you can still move forward with I-751. File for divorce and send USCIS a letter with a copy of your I-751 receipt notice and request a divorce waiver. They'll send you an RFE for the final divorce decree, which you'll probably have by the time they send an RFE. Make sure you at least get copies of all your AOS paperwork and other immigration-related paperwork before moving out. Sorry about your marriage.

So the attorney said I can be put at the procedure of remove from the country and that my husband can withdraw his sponsorship anytime he want to

Did you get a good attorney that has a wealth of knowledge about immigration issues specifically? I have been amazed since I came to this country how you find lawyers here basically dime in a dozen. Now, the expertise of them is a completely different matter. While help from respectable members of VisaJourney doesn’t constitute legal advice, I have learned that much of the information here is very useful when dealing with USCIS/NVC.

Getting there, slowly but surely...  (I hope )

Together (well...mostly the Transatlanticism kind of together) Since 12/2013

I-751:

I-751 Package Sent with UPS 11/11/2020
I-751 Received by the AZ Lockbox 11/13/2020
I-751 Check Cashed 12/31/2020
I-797 (with My Last Name Misspelled...) Received by Mail 1/2/2021

Biometrics Appointment Received by Mail...too bad I am in Europe right when it's supposed to take place 🤯 6/14/2021

Rescheduled Biometrics Appointment, the biometric technician can't change the misspelled name on file, but he enters the correct spelling of my last name as an alias 8/2/2021

Interview Ready to Be Scheduled 10/13/2021

(Two Days Later) Interview Was Scheduled 😱 10/15/2021

I-751 Interview, Petition Approved 🥳 11/19/2021

Case Status Changed to New Card Is Being Produced 11/19/2021

Case Status Changed to Case Was Approved 11/22/2021

Green Card Arrived in the Mail (Name Correctly Spelling, w00t) 11/27/2021

When USCIS Misspells Your Name:

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

That is why switching to divorce waiver is important. After switching, your husband can't ask USCIS to "cancel" the pending I-751.

Your soon to be ex spouse cannot prevent you from getting a permanent green card as a matter of fact he is providing you what you need to complete your case a divorce decree.

Get your divorce finalized right away and convert your i751 to a divorce waiver case.

The attorney is wrong if he indicated your husband divorcing you would prevent you from getting the conditions removed from your green card. The only thing you need to do is to convert your i751 case to a divorce waiver case and get your divorce decree.

If your i751 joint application is not converted  to divorce waiver case then your i751 will be denied, but it is easy to convert your case so you should consider doing that some day soon if your divorce case is filed and is already underway.
