I am a CR-1 conditional resident and we just started the process of removing conditions on my residency. Part of the evidence package recommendations was to include tax returns that we filed jointly. We filed taxes jointly 2020 for my first year of residency (calendar year 2019), but due to the dual status alien requirements (https://www.irs.gov/individuals/international-taxpayers/dual-status-aliens) we had to file on paper. Our check for taxes due was pretty promptly cashed by the IRS back in March, but since then we haven't heard a single thing. There is no transcript available via the online account either. When choosing 2020 tax year for the tax transcript, an automatic non-filing letter is automatically generated.

 

Prior to sending the I-751 we tried calling the IRS, but the whole hour and a half call left us more frustrated if anything. The phone reps kept giving us an attitude and transferring us to someone else (didn't know a transfer PIN was a thing since no-one on phone would tell us?). Nobody really knew anything and gave us the runaround. "I don't know, let me transfer you" => 10-15 more minutes listening to the waiting music. I know filing taxes are few people's favorite things to do during the year, but coming from an easy tax filing process (Scandinavia) to a mess that is IRS has been shocking to say the least.

 

Just don't want to get an RFE from USCIS because of lacking tax information if IRS can't get their act together--year of Covid or not. I would assume it will be difficult to file taxes next year if we do not have an approved tax return for the year prior.

 

I read something about a free IRS tax advocate. Has anybody used their services? Or would we have to go to a congressman to escalate the issue? Would appreciate any input from others who are better with dealing with the taxman.

When USCIS Misspells Your Name:

 

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

"We filed taxes jointly 2020"

 

First, get the common terminology correct so whomever you talk to knows what you mean. You filed your "2019 taxes," (it is always assumed you did it in the following year). 

 

"When choosing 2020 tax year for the tax transcript, an automatic non-filing letter is automatically generated."

 

That's because you used the wrong terminology; 2020 taxes haven't happened yet. 

 

"There is no transcript available via the online account either."

 

 

You must request tax transcripts by regular postal mail.

Why thank you for noticing that. Really helped me out. With an attitude like that, do you perhaps work for IRS? But you really didn’t read where I said something about 2019 calendar year. I am well aware that 2020 taxes are filed in 2021. I am terribly sorry for this unfortunate unclear statement, but I don’t think I can longer edit my original message.

 

CORRECTION:

Tax transcript for 2019 taxes is not available and instead gives a non-filing letter and an alert toward the top of the screen that no taxes have been filed.

 

Sheesh. I am on this forum for help, not for sneer remarks. Happy now?

 

CLARIFICATION:

My wife’s tax transcripts are available online for tax years 2018 and 2017.

That's because you used the wrong terminology; 2020 taxes haven't happened yet.

You must request tax transcripts by regular postal mail.

You can get them online after registering.

CLARIFICATION:

My wife’s tax transcripts are available online for tax years 2018 and 2017.

I filed my taxes via mail in as well, I waited until July 10th thinking they may move the date back to due COVID.  My check was also cashed a few days later by and endorsed by the US Treasury stamp on the back.

 

Last month I noticed my tax transcripts were not available for 2019, I called IRS and finally spoke to a person who said I should expect the tax transcript to show up sometime in December, and it was due to COVID.
