Good evening peeps,

 

My husband and I have been racking our brains the last hour trying to understand Part 8 of the I-175. I searched the group, but I only found the same questions from 2016, and the answers didn't help. 

My husband, the GC petitioner, filled out Part 7. Part 8 states its for the Spouse or individual listed in Part 4 (me). Whey would I need to add my name to the box acknowledging an ASC appointment on page 11? The instruction page doesn't even make sense to us, so we must be really tired or missing vital information. 

PLEASE HELP!

Maybe we filled the form wrong, but I thought that conditional resident spouse was supposed to sign in part 7 (it states in part "Furthermore, I authorize the release of any information from any and all of my records that USCIS may need to determine my eligibility for the immigration benefit that I seek.") After all, it's not US citizen spouse who is looking for an immigration benefit in form of removal of conditions, right? At the beginning of part 7 it also says "NOTE: If you selected Box 1.a. in Part 3., your spouse must also read and sign the petition in Part 8." Box 1.a. in Part 3 being basis for petition = still married to the spouse who brought you to the country.

 

..and if I am wrong, our form's probably gonna get rejected :cry:

(Two Days Later) Interview Was Scheduled 😱 10/15/2021

I-751 Interview, Petition Approved 🥳 11/19/2021

Case Status Changed to New Card Is Being Produced 11/19/2021

Case Status Changed to Case Was Approved 11/22/2021

Green Card Arrived in the Mail (Name Correctly Spelling, w00t) 11/27/2021

 

When USCIS Misspells Your Name:

 

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

Your husband is the conditional permanent resident. He fills out part 1. In part 3 he checks off that this will be a joint petition with his spouse (you). Part 4 asks about you. He signs part 7 as the petitioner. You sign part 8 as the spouse. There is a box you check stating everything is true and you will go to a biometrics appt (if they ask, and they never ask the spouse but they get your authorization to do so just in case they want to)

Yes, I know all of that. But specifically, Part 8 is not just a box you check. On page 8 you fill out your name. It states "I, (blank box to add name) understand that the purpose of a USCIS ASC appointment is for me to provide my fingerprints, photograph, and/or signature"...blah, blah, blah. All of part 8 pertains to the individual listed in park 4, which is me, and I am the us citizen spouse.
