Hi, everyone.

My fiance is a Chinese, who lives in Romania. I want to know if we can make the K1 visa in Romania Embassy.

I read the website of USCIS. It reads we'd better go to US embassy in China. However, it takes 6-12 months just in embassy in China. I heard it would be much faster if we go to Romania embassy.

From what i understand, unless she is a Romanian resident, you will need to go thru China.

I'm not 100% sure, so you should either wait for a member with more knowledge in this type of situation, or call USCIS or her embassy and the embassy in Romania but I think she could ask to be processed in Romania, in the chinese embassy there, but it's not guaranteed and they could instead send her case to China and let her know she'll have to be processed there.

The Chinese embassy does not issue U.S. visas. No foreign embassy or consulate does.

What do you mean? I mean the consulate, not the embassy, if you say they don't issue visas, how do chinese get their K1?

luis&laura, I think you have a typo in your post, see my bold in the quote.

The beneficiary cannot get a K-1 visa at the Chinese embassy or consulate. Only the US Consulate in Romania can issue the visa. That is what John_and_Marlene was referring to.

To the OP, if your fiancee is a legal resident of Romania, then she should be able to go to the US Consulate in Romania to get her visa. This link is to the consulate site in Bucharest. If you do a bit of digging here you should be able to figure out what the rules are regarding residency for non-Romanian citizens.

They go to the same place that anyone, from any country, go to get their K1--the U.S. consulate.

Thank all of you. I think she can get it from US embassy in Romania. She has the Permis de Sedere of Romania. Anyway we should try it. The timing in China is for killing people.

If she is a resident of romania she should be able to get it in romania, if she is not a resident of romania she will prolly need to file in china. call the us embassy in bucharest, and ask them, but i am 100% sure of what i am telling you.

You should send an email to the U.S embassy in Romania and explain the situation completely. Tell them the legal status of your fiancee in Romania, what type of visa she has, whether she emigrated to Romania or anything that would give them the opportunity to provide her with a K-1 visa.

Write to the visa section with your explanation. Give them a week or two to respond. You will likely get a better response than trying to make a phone call.

The last day we met is 2nd of Nov. 2005. If I fill in the form now, we are fine with the two years' condition. But when the interview will take place, I think it will be out of two years' rage. Should we meet again in 2007?

As for your meeting in 2005, you will be fine for the filing of the I-129F petition, but to strenghten your case at the consulate, when she interviews for the visa, you may want to get together again, after you file your petiton but before your fiancee has the interview. Take lots of pictures and have documentation of your time together. This will serve as futher proof of your "ongoing relationship".

You're good to go, as long as you file before November 2, 2007 and the appropriate Consulate or Embassy in Romania as the place your fiance will apply for her visa. You file your petition with either the California or Vermont USCIS service centers regardless.
