Hi all,

 

We sent off our I-129F in July , my residency was in UK and that was the address that I put down on our form.

 

I was in Hong Kong at the time of the application visiting family as a vacation but due to Covid, I have now decided to remain here longer.

Do I need to update this new information? and if so how?

 

My residency in UK is still valid, I just plan to return later than intended due to this whole pandemic. 

I still intend to use the London Embassy even though I am in Hong Kong. I will still want to fly back for the interview and medical. 

 

Any advice would be appreciated! Thank you.

Why? In HK you just have to wait for routine visa services to resume. In UK you have to wait for routine visa services to resume and the DOS "no visa policy" (for countries listed in the Covid Presidential Proclamations) to end.

because I’m only allowed to stay in Hong Kong for one year and I’m unsure what the future will be like as I am not a Hong Kong citizen 

 

I do not want to change Hong Kong as my embassy in case they don’t approve the Noa2 / NVC in time for me to book the k1 interview for the period that I am allowed to be in Hong Kong 

 

I’m legally a British citizen and can always return without any worry

It says on the I-129F that If I’m in a country for longer than six months I need to submit a police certificate from that country though 

so I would somehow need to inform them I’m in Hong Kong for longer than six months to explain why I’m providing a HK police cert right?

They don’t need to be informed that you are in HK. They will need a HK police certificate presented at your interview. If they want to chat briefly about it, the interviewer will ask.

I do not recall that the I-129F asks for that. 

 

It is a part of the fiance visa process, but happens at the embassy interview after the beneficiary fills out a DS-160.  It requires PCCs for all countries that the beneficiary lived for 6 months or more.  Also, it requires PCC's from any country where the beneficiary has been arrested.  A PCC from the US is NOT required.

 

 

Edit:  Originally, I incorrectly stated PCCs required for being in a country for over one year.

Yes my bad I remembered incorrectly 

I need to present it at the interview. I was in hk at the time of the application but planned on returning to U.K.  
I was just worried that they’d be confused as to why I’d be providing a hk cert when there is zero mention of me living in hk in the last five years on the I-129F 

 

I just hope they understand with the current pandemic 😕

Correction:  The beneficiary is the only one required to do complete PCC and only if they meet living in another country, from their home country, since the age of sixteen for 6 months or more. Just saying

But when it is almost time for the interview, the beneficiary will need to fill out form DS-160.  That form will ask the beneficiary for current and all previous addresses, and will require the PCC's from the appropriate countries.
