Hi all, few days ago I finally received a call from consulate in Hong Kong telling me my case is ready to proceed. Before they could schedule an interview, I would have to send them a document checklist along with the DS2001 - Notification of Applicant Readiness form. On the checklist, there's one item I am not too sure what's the best way to prepare for. It's the "Affidavit of Support". According to consulate website, "K visa applicants should provide proof of self-supporting in the U.S. or a job offer for you or a letter from the petitioner’s employer. Form I-134 (not Form I-864) executed by the petitioner and his/her federal income tax returns for the most recent tax year may be required when the consular officer deems useful."

My fiancée and I are both living and working in HK right now. Before obtaining the EAD, I wouldn't have an actual job offer that I could show to the CO. Since my fiancée is also working outside of US, how can she provide such evidence required on the I-134 form? What other supplementary evidence that could be used in my case?

How will your fiance plan to support you during the 6-8 months before you receive your EAD?  K-1 wouldn't seem an obvious choice for a couple who are living together abroad.

 

Your fiance will need a US-based job sooner or later for the AOS, so they may have to come back early to get it all sorted.  The alternative would be finding an eligible joint sponsor.

K1 does seem an odd choice.

I agree with @Jorgedig as the USC does need to demonstrate that the beneficiary will not become a "public charge". You'll need a sponsor for this phase of the visa process, but the USC will need to return to establish domicile with employment. 

 

BTW, have you filed your US taxes reporting your HK income. That will be scrutinized at your interview.
