Question about DS160 - has anyone filed an immigrant petition on your behalf?

Timeline

Hello everyone, so my fiancé and I starting to look at the DS160 and were wondering what to put for this question: “has anyone filed an immigrant petition on your behalf?” About 10 years ago, my fiancé’s aunt had filed a petition for her sister (fiancé’s mom) and her family to come to the US. That is still in process and they have not yet received approval on that. However, my fiancé has also aged out for that case since he’s now over 21. Would this be an issue for our fiancé visa? Would we just put “yes” and then explain in the commentary that the prior case is still in process but he has already aged out?

Yes, someone filed a petition on his behalf; it does not specify if you aged out, if it was denied, etc. Straight forward- has anyone filed an immigrant petition on your behalf.

No, that will not affect your K1.

Interview Date : 12/1/14                           Interview Result : Approved !

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

No, that will not affect your K1.

No petition was ever filed for the OP.  The OP was not a named beneficiary but merely a possible derivative.

For my knowledge; to clarify, being a derivative does not count as having a petition filed for you even though OP's name would have been on his mothers petition and would have potentially benefited from it?

Correct.  To have a petition filed for you,  requires you to be the named beneficiary.
