(F) Actually, I don't know amrssnowangel if our NOA1 is supposed to be of the 30th or the 26th of June, as we got the hard copy on the 30th, but later when I created an online account , I saw the notice that they sent us a NOA 1 on the 26th. So then, maybe we have the same date of NOA1 !

I believe very much that all of you will hear from VCS very soon !!!! Only positive thinking, guys !!! Though it was very hard at times for us but we tried to stay positive as much as possible. Also, a BIG THANKS to all of you (F) (F) (F)

Hello everyone, I have a bit of breaking news to share with you all.

I sent this email to CIS Ombudsman maybe a day or three ago:

Dear Mr. Khatri,

I write to you with a sense of urgency today. There is a new problem cropping up within USCIS in regards to the processing of I-129F petitions for K1 Visas.

Mr. Khatri, the service centers, particularly the Vermont Service Center, have actually processed several cases that are only a month or two old, from petitioners who have filed in the months of September or even October. While I hold no ill will towards these petitioners, I am slightly perturbed at the service centers.

We as petitioners have always been told that the service centers process on a 'first come, first serve' basis. It only makes sense that those who filed in June get approved before those who filed in July. However, we are currently just into November, and there are a multitude of petitioners from June, July (like myself) and August who have not seen any approval notices.

Mr. Khatri, we are starting to feel that we cannot call the service centers or USCIS for any information because any time someone calls, we get nothing but customer non-service, as representatives are clueless as to what is going on. Often these reps are rude and discourteous to discouraged petitioners who have no idea why their petitions are stuck in limbo.

Mr. Khatri, please do whatever is in your power as soon as possible to make sure this problem is rectified. As a petitioner who filed in July, I would like the system to work in the way it is supposed to be. June before July, July before August, August before September, and so on down the line.

Please get the Service Centers to get back in line, literally, in approving our petitions. It is bad enough that we have seen processing times spiral out of control. If we no longer have the order of months to go by, what else are we to do but cross our fingers and hope? With all due respect to you sir, that is unacceptable, and it needs to be fixed.

Today I received a reply from the someone in DHS:

Mr. Joslin – The CIS Ombudsman shared your email with me. We do try to process fiancée cases on a first in – first out process. That being said, every case is somewhat different. Some cases are particularly well documented; in others there can be background or other issues that can affect how long the overall process takes. On a national basis the statistical average processing time for fiancée cases is 5.2 months, versus a goal of 6 months. Vermont’s timeframe has recently stretched to just over 7 months because of the surge of applications that we’ve recently experienced.

I would like to have our folks take a look at your case, which you indicated you filed in July. I’d appreciate any specifics, such as receipt number, that you’d like to share to help us in that regard.

The language you used in your email suggests this isn’t your first experience in filing a petition or application with us. I’d also appreciate any other perspective you’d like to share with respect to your past experiences.

So all you June, July, August filers, try to get the ear of this guy and see what happens!!

I think the noa1 date is the date they have on it. Mine says June 19th recieved. I think the 26th is when I got it in mail..but I think the actual noa1 date is what is listed on the noa1...so for me its the 19th. They are supposed to work these in the order which they are "received" but who knows...LOL

Actually, I have no clue how they are working there. Seeing such a slowdown, we thought our approval would come at best like the end of November or December.

I took your suggestion...I emailed....I think we all need to keep them on their toes. Just because they are turning out some petitions doesn'tmean it still wont stop again or get worse....Keep the pressure on...

I just read the thread. I am not an expert, but I do have some suggestions. You have to take everything in steps and you have to be extremely organized.

Step1: Fire your current lawyer

Step2: Please, please do not send any documents to USCIS without "new" legal representation

Step3: Retrieve all copies of your original application, the RFE, your response and all it's contents, and the denial letter.

A copy of your second application and the RFE letter.

Step4: You need to take all these things to a "new" reputable lawyer. Please get someone with at least 10 years

immigration law experience. You have to be careful about the type of lawyer that you take. Bring all the

documents to him/her. Give them the full version of the story and all the documents.

Here is your problem.....

How ever, you haven't submitted all the disposition for the criminal convictions you check off that you had. The letter form the department of public safety clearly notes that the records of that department don't reflect if you have been arrested by any state, local or federal law enforcement agencies. Further that inquiry was based upon name check only and is not supported by a fingerprint comparison. Therefore, the letter submitted doesn't establish that you checked off any of the boxes in error on questions 2 and 3 of page 3 on From I-129F...

1. You need to address the fact that you checked off the wrong boxes in a letter

2. You need to do a full criminal background check using fingerprints

Please if you can just relax, and do this step by step....I promise you that it will get you an approval!!!

Apparently they are aware that USCIS approves cases out of received date to minimize backlogs:

Pending Cases, #AR2007-02

The Ombudsman has observed that newer cases are processed more quickly while cases more than six months old are increasingly backlogged. The Ombudsman supports the USCIS drive to maximize case completions, but attention needs to be directed at clearing older cases. The Ombudsman recommends that USCIS provide a clearer picture of the current backlog by providing information on the number of pending cases by form type with receipts that are: (1) less than 90 days; (2) less than 180 days; (3) less than one year; (4) less than two years; (5) less than three years; (6) less than four years; and (7) greater than four years.

Hey, the Joz - Thanks for the4 info!! I somewhat pirated your letter, but made some pretty significant changes to it and fired it off to the ombudsman. I didn't feel comfortable using the name you supplied! I will let you guys know, what, if any, reponse I get. Lets keep on fighting!!!
