hello everyone, i have a question about exedating my case for cr1 spousal visa at uscis stage. I'm opening a busuness in USA (already registered) and need my Husband to to be in usa to support me and help me emotionally and fianacially. I have 2 kids and can't make it all by myself. He is helping me aboard so far  by covering some costumer service but I need him to be here soon.  having a job, opening a business and kids it's way too much for one person and he is the only one i can trust and i can count on to succeed in this business. Any advice will be appreciated.

Thank you in advance.

Apply and find out. Be ready with documentation of why the expedite is needed. They may or may not request it, but better to be ready than not.

I'd be a little surprised if this met the requirement to expedite (basically every business owner would do this if so), but there is no harm in trying.

Expedite criteria for reference: https://www.uscis.gov/policy-manual/volume-1-part-a-chapter-5

I'm assuming this would be under "Severe financial loss to a company [1] or person, [2] provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to file the benefit request or the request to expedite in a reasonable time frame; or (2) to respond to any requests for additional evidence in a reasonably timely manner;".

"Severe financial loss to a company means the company would be at risk of failing."

Note that it's not expediting the visa - it's expediting the petition. USCIS doesn't handle visas.

You can file for the expedite but do not expect this to hurry up the visa process

the USCIS paperwork may go thru faster but the NVC process has always been up to you to pay the fees in a timely manner and get the supporting documents to NVC as fast as possible (you can help with this now by getting the IRS transcripts for 2019, 2018 and 2017 and have them ready) The 2 criminal reports should not be done until requested by NVC as one of them expires in 90 days.

After the interview,  Casa puts all in AP for weeks or months for review of the security ds document

you really need to know all the ups and downs of this process in Morocco

If you are working for someone else, you may want to keep that job and delay opening the new business till he is here
