USEM/CRBA Finally

I was in the Philippines before the lock down and my wife and I took our boys to get their CRBA. I accidentally grabbed a copy of our PSA marriage certificate instead of the original. No big deal, they said send it to them and once the received it they would process it. Well they received it on 3/10 and then came the lock down shortly after.  Finally today my wife received their CRBAs and passports. I am extremely happy because now they are officially US citizens. Along with the packages they send some papers about getting their SSN's and about exiting the Philippines. The part about exiting the Philippines I was not aware of. Since they are dual citizens I thought they would just be able to leave. Here is what they sent.

Anyone know about this? Will it cost me money?

Do your boys have philippine passports?    If they don't ... GET THEM!!

 

You can totally avoid the ECC issue by them having Philippine passports.   After all they are dual citizens

ADDITIONALLY  - APPLY FOR THE PHILIPPINE PASSPORT
Why should you apply for the Philippines passport?  When existing the Philippines with the child having the Philippine passport will remove the ECC fee that would be charged if the child only had the U.S. passport.  The ECC fee can amount to thousands of dollars. 

Once you have the PSA copy of the birth certificate take that and a completed application to DFA.  Minors 7 years or younger do not need an appointment.

Okay that's a relief. We left the Embassy after our CRBA appointment and went straight to the DFA and got their Philippines passports.

Great -  Just remember to use the Philippine Passports when entering and leaving the Philippines. No issue there!

Actually they need to use the U.S. passport ..  otherwise "they" will be looking for a visa in the Philippine passport.

I was under the impression that dual citizens typically hand over both passports when entering and leaving.

Finally done.

Philippines does require that a dual citizen present the Philippine passport at entry or exiting for that matter.

 

The situation is different for the OP, the children were born in the Philippines and have no entry stamp in their U.S. passport.   If a foreigner has been in the Philippines for 6 months or longer they must pay an ECC fee when leaving, so in the case of the children this fee could be nasty if they didn't also possess the Philippine passport. 

 

  (those with a BB stamp are not required)

Correct, but if the child is flying to the US, they would technically need a visa in the Philippine passport to get there.  They would be forced to show the US passport where immigration would require the ECC.  The way around it would be to fly to a 3rd country on a separate ticket, then connect your way to the US.  If you are not flying to the US and going to a regional country, then no issue at all with the ECC.  We have never had an issue flying into regional countries for any kind of trips we have done and never needed this

 

Just FYI.  By law and confirmed by our lawyer in Manila, both passports should be shown when leaving the country but we have never done this.  We will though on the flight to the US.  

 

If you ever plan to travel with your child without the mother/father, you must get clearance for this from the Philippine government.  The only thing I can commend immigration on is they are extremely strict on this requirement if both parents are not flying.  They do look out for children very closely.

There was a :oops: typo in my previous post, it should read Philippines DOESN'T have a requirement to enter using the Philippine passport for dual citizens.

 

There is no ECC fee for the children being the have both passports, they present both to avoid the ECC fee.    

 

BTW your lawyer is wrong .. read the actual law.   Don't need to present both passports when exiting either .. exception; children in the situation of the OP.   (of course your lawyer did say "should" which in itself means it isn't required)

 

 

 

As for children traveling without the parents.  Under the age of 13 a child can not travel alone, a guardian is required, along with the completed/notarized form from DSWD.
