Hello everyone, 

I have a question. I am the petitioner for my spouse, whom lives abroad. Right now, we are at the NVC stage of the process. To give you all a little background, I am a student in college right now, and since I’m not able to work full time, I don’t have enough income to support him. I want to use my father as a co-sponsor, he is married to my mom and they file their taxes jointly. I am currently working on the affidavits of support and here are the questions I have: 

- should I make my father a co-sponsor or a household member (we live together at the moment)? 
- based on that, which forms do we need to fill out? (In any case, I know my dad and I, both need to fill out form 864)
- since my parents file their taxes together, does my mother need to fill out affidavit of support as well?

Would appreciate all the help!

Hello,

 

If your father makes enough income with your mother combined, then you should make your father a Joint Sponsor. He would fill out the I864 form and you would attach your mother's I864A to it. Your mother in this case will be a household member to your father. You will go ahead and fill out your own I864.

 

Hope I'm clear with this.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
