Hi everyone, I have a couple questions that I can’t seem to find the right answers for and I’m basically intensely nervous at the thought of messing anything up. So if you may know any of the answers I would really appreciate it.

 

  • I’m likely about to lose my Job due to the Covid-19 situation, so I’m wondering if I should submit the K1 “i-129f” application now while I still have it and list my current employer, or if I should wait until I have a new job?
    • Is this resolved by having “joint sponsor” and bringing an “i-134” Affidavit of Support to the interview correct? - Can a retired parent joint sponsor?
    • Similar question for current physical address, if I expect to move in a month is it ok to submit now with my current address even though I’ll be living somewhere else as it processes? (mailing address will remain the same)

 

  • During work at my current employer I had an official ‘Leave of Absence’ where I worked for a different company for 1 year but still technically stayed an employee of my current employer – Should I count this as 3 separate items of Employment History, or 2 with overlapping employment dates?

 

  • For Address History how exact do you need to be? Previously my partner was living outside their country learning English, and at that time they were doing some couch surfing essentially for 2-3 weeks at a time in between apartments, and has no easy way of finding those addresses at this point - is this going to be an issue to have gaps? I have seen other posts say only include mailing addresses, but this would completely exclude time of about a year spent out of their country, which seems like a potential issue.

 

  • Several fields on the electronic PDF of the application don’t seems to be long enough, such as addresses and phone numbers, should I write these in manually then after printing out instead?

 

  • Finally, the instructions say “If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed.” But in the electronic PDF many of the fields are locked or don’t allow “/” – should these “N/A”s all be manually written in after printing out?

 

Thanks in advance for anyone who may be able to answer a question or two. It would really help me put my mind at ease.

i can answer these two for you and comment on some others. Hand write what you can not type out. If you have a section that you need a lot more room- I think we did for describing how we met- we wrote “See Addendum” we typed out how we met and Attached it as an addendum at the end of the I129f.

 

 

In my opinion I would submit everything as long as it is complete before you lose your job- no point in waiting really . You need to show your ability to financially support later on and hopefully you will have a good job. A retired parent can be a joint sponsor pending they meet the requirements/understand the requirements/consequences. Not every consulate accepts a joint sponsor so hopefully someone familiar with Japan can chime in. During your leave of absence did you collect any payment from that job? If not I wouldn’t include it as it would not be reflected in any of your tax returns. Again, hopefully someone else can chime in.

Thanks for your response. While I was on LOA I did't receive any regular monthly salary payments, but as I happened to work there about 4 months into the year's calendar before going on LOA, still got some things like a small year end bonus and small employee stock purchase benefit while on LOA, so there was that aspect of it reflected on my taxes.

Your job status is irrelevant when the petition is filed.   Sponsorship capacity is determined at the interview

If you are the beneficiary, salary is not a requirement for the interview nor for the initial application. The petitioner needs to submit financials for the interview using I-134, Affidavit of Support.
