Looking at the 1099 tax form, there's tax exempt interest. Is this considered income or assets on the i864 form?

What should be done if income + tax exempt interest combined into over 125% of poverty guidelines but alone the total income doesn't?

Income is income,   taxability does not define what income is or isn't

Sorry, I meant the 1040. 

Section 2a shows tax exempt interest, and section 6 shows total income. The interest isn't included in the income. 

 

Does it count as income or not? For the purposes of the i864 form.

On the 1040. Line  8b is your adjusted gross income. That is the figure you use on the I 864. Thats what i used.

Also the poverty Guidance has been recently updated as of March 1st

Once again,  taxability does NOT define income.

The additional information also has the tax exempt interest (in addition to showing up at section 2a). What should I put for the actual gross income in the i864 form though?

I still don't know what to write in the i864 in total income for 2018. Anyone has a clue?

Like I said on the 1040 the total income doesn't include the tax exempt interest, but obviously that interest is income. Do I combine it?

On question 24, they ask for Adjusted Gross Income. There's a line on the return that has exactly that. That's exactly what you put in the form.

 

Question 7-20 asks for current annual income. That's the number they're gonna use to determine if you're above the poverty line, unless you're self employed.

If that's how IRS calculates, there's nothing you can do about it. USCIS is gonna look at the form and it's gonna compare to that line on the return/transcript. If it's a different number, they're gonna send an RFE saying that you didn't complete the form correctly.

 

You should make sure you send enough information for CURRENT income. That's what matters the most.

I got an RFE despite sending paystubs + letter that show more than adequate current income.

From what I understand it's due to not including 1099 and W2. 

 

Now that I re-read the RFE letter a few times, I'm pretty sure I don't need to re-fill a new i864... so this thread might be irrelevant. I hope I'm right in this. Thanks for the help though.
