I have  a question. What if I must leave the United States before I can file a Form I-131 for a reentry permit?

 I did apply for i-485 and i proceed through the biometric already. But, since my family is in need of me i need to leave the USA and stay in Russia for about a year. 

 what should i do?

Please fill out your timeline - without any background info you won't be able to get proper advise.

 

General info: if you leave the country before you have received Advance Parole (in hand), your I-485 is considered abandoned and you will have to apply from Russia for whichever visa you fall under.

Thx i filled out everything i have remembered. 

Is thee anything i have to file out before i leave? how \do i notify them i am leaving. Just understand, i am asking to be sure i will not face any issues in the future and be able to come back when my situation in Russia is resolved.

What could be the possible visa i will need to apply from Russia? K3?

K3 is obsolete - you will have to go through the CR1/IR1 process.

It's probably nicer to pull the AOS before you leave, and explain why.

IR1 visa.  Your spouse will file an i130 petition

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You must have filed the I485, I131 and I864 as a minimum.  You would have to return for the AOS interview. You can only remain out of the US for less than a year. 

 

If you have your Conditional Residency then you can file a I-131 for a stay outside the US upto the length of the Green Card.

You said you have filed I-485 which is pending adjucation. If you are planning to travel, which means you abandon it and will apply from outside of the country, it would be nice if you pull the I-485 so they can take it out of the queue and somebody else gets the waiting place instead.

I did file i485, and i864 as requested. Form  i131 was not sent with the entire package since i was not expecting to leave the US. I know i am able to send the form at any time, but the instruction of the form says that i am able to stay outside of US only 90 days. This term is not enough for me.

Don't waste USCIS processing time on the I-485 if you are just going to abandon it.   That time could be used on someone else's I-485.

got it. that is what i aam willing to do in case there is no other chose to proceed with the case or extend it.

The form is used for multiple purposes.   AP can be used for upto a year out of the US.

You can still file a I-131 and ask for it to be expedited.
