Hi everyone, regarding question 9 from form DS-5540 public charge questionnaire. It asks to list assets available to the applicant. I (the petitioner) would like to list my assets (bank account, 401k, Roth IRA, HSA) onto here since my wife does not work and she does not have much asset. These assets will be available to her anyway, is this OK to do?

Did you find out ? because i have the same issue . I do not work right now and i am worried if it will cause deniel... Will it be enough if my husband proof that he will support me ?

I'm waiting until our interview to prepare this form. Currently, honestly I'm not sure if I will provide my assets or not. Some on here suggest that it is OK while some others do not. I'm having split opinion on this right now. I think if you do provide your husband's asset, make sure you state that it is his on the form. I'm thinking like for example writing 'Spouse's asset name.' 

 

This form is too new, hopefully we'll get more information on this.

Yes there is really limited information!! I feel stuck sometimes but please update if you find the answers. Thank you so much !

I have wondered the same thing. Hopefully someone who brings this to the interview will tell us.

Definitely! I think not all interview officers are requesting the forms right now, but it is always good to have the correct information.

How is everything going, is there any news on your wifes statues? Was it a problem that she did not work (public charge wise) ?

For what it is worth, there is not yet a definitive answer to whether to list the petitioner's assets as available to the immigrant spouse.  However, because of the wording, if I were doing the form today, I would list petitioning spouse's assets as "available to" the immigrant spouse and any step children as applicable.  Consular Officers can see from  the asset documentation, who owns the assets.

Facts are cheap...knowing how to use them is precious...

I agree. This is what I'm also doing when preparing our DS-5540 for the interview.
