K-2 Visa for my wife's son

Timeline

My wife arrived in the us last July

We got married in August and she just received her green card 2 weeks ago.  We filed the K2 paperwork 2 weeks ago to bring her 13 year old son to the us.   It seems like appointments are scarce at the embassy now.  April is full.  May apts not yet opened.  Any guess how long the appt will take and how long to get his visa after the appt?

I'm also in the same situation. I moved to the US using K1 and my green card interview is coming up this March. I'm planning to bring my son to the US after I receive my green card. How did you file for K2 visa for your wife's son? What form/s did you submit to file? Thanks!

Follow the consulate process that you did for your k1.  Process is the same except for the age appropriate documents

According to your timeline a year has passed since your visa was issued.   A K2 has to be issued with a year of the K1.  That would have been the easy way.

 

Your USC Spouse can file an I-130 for your son.  It will take over a year.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Jonan - I'm so sorry to be reaching out to you so late.  I used Rita Visa Advisors in Bangkok. good for me, because they work directly with the embassy in taking our paperwork to them, and they took my wife's son to the hospital to get his medical exam in March.  Now I'm not sure if he's going to get an appointment or not.  ritavisaadvisors@gmail.com 

The cost, while not cheap, is in line with other companies and they have always been responsive to me, even on weekends.

With Trumps latest decree, I'm not sure if I'm going to be impacted or not.  My wife received her Visa on jun 26, 2019.  We have to have his visa issued by that date.  He has an interview in the BKK embassy scheduled for May 5th, if that is even held.  Some of my questions, which I'm sure no one knows the answer to right now:

 - Will he even have an interview on May 5th.  Embassy is closed indefinitely.  I sent an email to try and expedite the case, given his circumstances, and this is what they told me.

 - If May interviews are canceled what happens if revised interview date goes past the 26th of June?  Will the US govt grant extensions due to Covid-19?

 - Even if he gets a visa, would he be allowed to travel to the US, if flights are available?

 

Just a lot to worry about, but nothing we can do but wait.....

Well, it looks like the May 5th appointment at the bangkok embassy is canceled.  This is a global situation that affects everyone.  I hope the US Govt will extend the one year timeline we are on and give us an additional 3 months to file.  I wond err r if I'm asking the impossible though.

If it is a discretionary item you might reasonably expect an accomodation,  if it is hardcoded into the law, not likely.

Timeline

Called the National Visa center on friday.  Basically they stated they are not allowed to give any advice on when the offices will open or if extensions will be given.  I understand because nobody knows at this point when something like this happens.  I only hope this is a once in a century occurrance.
