Hello all, 

 

These forums have been really helpful but I'm stuck on something. I just received an RFE (filing for I-485) and it requests petitioning sponsor's tax documents. I did send them this along with paystubs and I definitely make more than the poverty guidelines. Then it says that I did not meet the guideline and will need a joint sponsor. So do I file another I-864 for myself as the petitioner and then another for the joint sponsor (two I-864s total)? In either case, when filling out the joint sponsor's I-864, do I check "I am the only joint sponsor" box? Or are they "joint" sponsoring with me? 

 

I hope this makes sense what I'm asking.

Did you sent the tax return or the tax return transcripts? If you sent the return did you made sure that you sent every paper that needs to go along with it?

If one of these is missing e.g. W2 than they won't even look at the rest and mark your income as zero instead. That's why they say you didn't make enough money even though you do

Yes.

If the joint sponsor has a co-sponsor (ie. Household member) combining income with THEM youll need that co-sponsor to file an I864a too and provide everyone's financial documents.

 

In either case, when filling out the joint sponsor's I-864, do I check "I am the only joint sponsor" box?

Yes.

 

Or are they "joint" sponsoring with me? 

No. You are the original sponsor. They are the only joint sponsor. Unless you are providing a DIFFERENT joint sponsor than the original joint sponsor. Then there would be two joint sponsors.

Once they don’t accept the Affidavit of Support and supporting financial documents you submitted, they automatically tell you your income isn’t sufficient not because your income isn’t sufficient but because you haven’t proved it to their satisfaction because you either did not input the correct amounts into your Affidavit of Support based on your financial documents or you did not submit correct or complete supporting financial documents.
The error is likely not in the amount earned not meeting the guidelines (unless your current income wasnt stable or new employment) but moreso in the form or the financial documents you provided.

 

Confim exactly what tax forms were provided in detail (actual tax forms submitted to the IRS including all pages and schedules of the Federal tax return AND earnings statements OR the return Transcript? Did you file as MFJ? If so youll need the earnings statements with the Transcript too).

 

Confirm that your amounts input the financial documents provided EXACTLY. They will not take an estimate.
