  1. USCIS posted a new I-864 Form that must be used starting on 10/15/2019. However, I looked at the new and current forms (side by side) and can't find any differences. Does anyone know what changed, besides the edition number? https://www.uscis.gov/i-864
  2. Hello all, These forums have been really helpful but I'm stuck on something. I just received an RFE (filing for I-485) and it requests petitioning sponsor's tax documents. I did send them this along with paystubs and I definitely make more than the poverty guidelines. Then it says that I did not meet the guideline and will need a joint sponsor. So do I file another I-864 for myself as the petitioner and then another for the joint sponsor (two I-864s total)? In either case, when filling out the joint sponsor's I-864, do I check "I am the only joint sponsor" box? Or are they "joint" sponsoring with me? I hope this makes sense what I'm asking. Thank you for your help!
  3. Hello, My situation is: I'm a US citizen, never employed, and I'm dependent on my parent. they have been maintaining me my whole life. So I never filed taxes in my whole life. and I do not make any type of income ! nor I have any assets. The Case: I got married and my wife is filing AOS. For the affidavit, I had a joint sponsor filing separate i864. For my i864 I believe I'm required to attach a letter stating why I never filed taxes. what should be the reason to write, since I want it to look formal. I had this sample but I think it might need to be edited To Whom It May Concern I, ABCD, XXX's spouse and petitioning sponsor. I did not file any income tax return yet because I was and still dependent and maintained by my parents upon their income. Since I never had job or made any income of any type, I was not required to file an income tax return with the Internal Revenue Service. I, ABCD, certify under penalty of perjury under the laws of the United States that the information I have provided in this statement are true and correct.   4. Hi all I am a K1 Visa recipient and my husband and I are filing our AOS soon. I have a question regarding the required tax documentation on the I-864, Affidavit of Support. I understand that if we file AOS before the end of 2019 our most recent tax year would have been 2018, and we've got that. But if we file in January 2020, would our most recent tax year be 2019 already, thus requiring the proper documentation for 2019 instead? I ask because the company my husband works for doesn't send out W2s until February, but we REALLY don't want to wait any longer to file our AOS because my I-94 had been expired since October 22nd. We've planned to file this December 16th but something came up, and we might have to reroute the budget for that one onto something else.... sigh (I know, I know, we're filing late, but life happens and so here we are...) 😅 So I'm thinking: 1) Perhaps USCIS would allow the submission of 2018 records due to the fact that tax season for 2019 won't be over until April 2020 anyways? 2) Perhaps we could include an explanation on our cover letter as to why we're submitting 2018 records despite 2019 ending? So yeah, I would appreciate any input from anyone who can help. Thank you all
  5. I am(US citizen) filing for my spouse in family based category(I-130,485,864,765,131) who is on H1b(with I-140 approved through employer). Little back ground: My spouse was on student visa and then got his H1b. I have few questions(regarding filing of 864,765,130,485,131). I will appreciate if you can help answering these 1. On form I-864 part 6 >> point 7 >>My Current individual annual income is? Shall i enter approximate amount based on YTD numbers listed on my most recent paystub? and calculate end of year YTD number based on current paycheck? 2. on form I-485 Part >>point 2 &3 Receipt Number of Underlying petition? Priority Date of underlying petition? shall i leave these blank? or does my spouse need to enter employer based I-140 petition details here? 3. I-765, Part2>>point 12>>Have you previously file I-765?. My husband filed I-765 for student EAD after his masters degree. what shall i select in this section (yes or No)? also point 26 under part 2 asks for SEVIS number. does my husband need to enter his sevis number from I-20 during student visa status? Currently my husband is on H1b(as mentioned in beginning) 4. I-131 does my husband need to complete part 5? 5. I-130 part 4 >>point 10>>Has anyone else ever filed a petition for the beneficiary? My husbands employer filed petition based on employment based category (currently I-140 approved his priority date is not current) . what shall i answer to this question? currently me and my husband are living in different states and he is trying to find a job in my state(California). is it ok to enter his Florida address in point 12 of part 4? 6. I-130 point4>>>>46d Date authorized stay expired or will expire as shown on I-94. shall i enter date mentioned on my Husbands most recent H1b 797 approval notice(bottom of 797 has I-94 slip attached with dates) he recently got his H1b renewal done 7. form I-130 Part 4>>> point 61a and 61 b the benificary is in US and will apply for adjustment of status to that of lawful permanent resident as USCIS office in ? mention city? State? what should be my answer here? if my husband moves to California next month or so because of job) not sure what to mention here? please help
  6. Hi everyone! My USC self-employed husband and I are living at his parents' house, and his income was not sufficient to go over the 125% poverty threshold, so we had to use his Mom and Dad's income to qualify. They signed two forms I-864a and we filed it along with my husband's I-864. His Mom and Dad are in their 80's and their health condition doesn't look promising, unfortunately. It is going to take a while till I get my permanent residence in the US. My question is if there is an option to find a substitute cosponsor to support my case? I've only found the info about getting a substitute sponsor for the main I-864, not 864a, as well as for a joint sponsor. But in this case the cosponsors are the members of the household. I am worrying that in the worst case when my In-Laws pass away I am not going to be able to replace them to support my application. I would be glad to pick your brain guys, who know ins and outs of this bureaucracy. I really appreciate your advice and ideas on this matter. Good luck to everyone!
  7. I have filled out the affidavit of support form using Adobe Acrobat reader. After filling in all the required information, I signed the document with my mouse. Is this sufficient for the interview? Or do I need to hand sign it with a pen? I understand for the NVC phase this is probably ok, but I don't know about if it will count as an original copy for the interview. Thanks for your help.
  8. Hi, I am adjusting status from student visa to green card through marriage. My husband is my sponsor but his income falls below the poverty guidelines by $400 so we are using assets (bank checking accounts). We have 2 joint checking accounts so my question is: since it's a JOINT account with both our names on it, should we put it on I-864 as MY assets or HIS? Also, under Current Annual Income, for his expected income for this year, should he put his taxable income or both the taxable and non taxable ? He is self-employed and on 1099. We are also using a letter from his "employer", since he is self employed and on 1099 what should be the wording on the employer letter? Thank you so very much for your help!
  9. I am currently an F1 student on an OPT, and my husband is a PhD student sponsoring me for the green card application. His income is 24000 as a research assistant every year since 2014, but in 2017 his professor was not able to pay him during the summer which brought his yearly income down to 18600. I am teaching as a part-time faculty at a university, which means my salary fluctuates every semester depending on my teaching load, but my pay is approximately $8000-$10000 annually. Because my husband's income is over the 125% I wasn't planning on using my income, but on form I864 it will be filled out 2018: $24000, 2017: $18600, 2016: $24000. Should we attach my income just in case?
  10. Hiya! I'm putting together the last pieces for to file for AOS for my husband. He came on a b2 visitors visa in October of 2017 from Canada, we got married in april 2018 and are just now getting around to the paperwork. I graduated from college last May and jumped into full time employment in June 2018. Last year I made around 30k (only worked full time for half the year), and this year I'm expecting that number to be 55k+. However, at this point in the year I've only made around 16k of my expected 55k. I plan to include pay stubs and my offer letter from my employer showing my salary. Would it be wise to include supplemental materials (such as an account at TD Ameritrade for buying/selling stock) to solidify my case? I have a couple thousand dollars in a single stock account, and a couple thousand more in another account from an inheritance. If I include one stock account, do I have to list the other? On the 864 Part 6 number 7: "My current individual annual income", I believe I can put my salary of 55k as the the instructions permit "You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income.". I'm going to add paystubs and the offer letter I got from my employer showing my salary (55k) but I'm nervous that since I've only made 16k at the time of filing, that it won't be enough and his AOS will be denied. TLDR: Expected income will be over the 125% of the poverty level for the whole year, currently haven't made enough this year to meet 125% of federal poverty level, should I include documents showing ownership of stock? If so, do I need to include all different stock accounts (like if one is at TD Ameritrade, and the other is at Charles Schwab, do I have to show both or can I show only one?) Thank you all!
  11. Hi everyone! My husband and I are filing the I 864 form and I guess we're totally lost here. First off, we are living with a relative of mine and we don't pay rent. My husband is currently studying and doesn't have any income to report, being dependant on his parents. We are planning on having both his parents and my relative filing as joint sponsors. My question is: where in the form do we say that three people are filing as joint sponsors? In the instructions it says that there cannot be more than two joint sponsors so I'm a little bit confused here. In Part 6. "Sponsor's Employment and Income" there's a section that says "Income you are using from any other person who was counted in your household size" but this doesn't apply to us as our sponsors are relatives, not dependants. Is there any section in the form where the petitioner sponsor lists the joint sponsors? I guess I don't fully understand how the affidavit of support works. For our household of 2, the income would be $21,137 or 125% of HHS Poverty Guidelines applies. If my husband has a $0 income, how much income do joint sponsors have to show and how does their household play here? They do not have any dependents besides their spouses, so would their household for this purposes be of 3 people? (his mom, his dad, and me; and for my aunt, herself, her husband, and me?) Part 5. 3. "If you are currently married, enter "1" for your spouse." I am assuming I leave this blank since he is sponsoring me, his spouse? Part 6. 6. and 7. Since my husband is unemployed, his income is $0. However, he does get a regular allowance deposited to his bank account. Is this considered income? He's never filed taxes and I don't think his parents have counted his as dependants of theirs in their tax returns. Will a $0 hurt our chances of approval even if we have joint sponsors? I submitted the past 3 years of tax returns for myself and my co sponsor.. as per the request on CEAC stating "tax return or transcript" I got a notice saying they cannot accept those documents and I need to send in a transcript. Unfortunately the IRS won't let me retrieve it online or by e mail and their service center is so backed up they won't take calls. did anybody run into this issue? which tax documents did you submit? I am trying to find a way to get around this as its the thing holding us back from getting to move on. thanks
  13. Hello, I have one more 864 question. I am self-employed, so I ordered and received a copy of my most recent tax transcript. In the 864 instructions it states: "If you selected that you are self-employed, you should have completed one of the following forms with your Federal income tax return: Schedule C, Schedule D, Schedule E, or Schedule F. You must include each and every Form 1040 Schedule" Is my tax transcript sufficient, or do I need to attach a copy of my Schedule C and Schedule D too? I know this info is already in the tax transcript to a degree.
