Is it OK to send just the front of the USC petitioner's birth certificate? All details (parent's name etc. is there on the front), the back has no information. Previously we had sent a copy of passport bio page with the front of birth certificate as well and got approved. This time the passport has been sent for renewal (ran out of space) and we are not sure if we should be sending copy of the bio page of the passport since the USC petitioner will have a new passport issued to them soon.

 

What should we do, send both (front of birth certificate and bio page of passport) or just front of birth certificate?

What are you trying to accomplish and why do you think you need to send a copy of the new USC passport?

Ummmm as the title clearly says I-130 petition. Hence trying to demonstrate the U.S. citizenship (by birth) of the petitioner.

You only need to send one or the other, either US birth certificate or US passport, you don’t need both

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

What instructions? The VJ guide says - "Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship."

 

I've also checked the I-130 instructions, it does not say anything about "unless the back is blank". Would you mind including a link?

Did you provide the following?

  • Evidence of U.S. citizenship, lawful permanent residence, or U.S. national status:
    • A copy of your birth certificate, issued by a civil registrar, vital statistics office, or other civil authority showing you were born in the United States; 
    • A copy of your naturalization or citizenship certificate issued by USCIS or the former Immigration and Naturalization Service (INS); 
    • A copy of Form FS-240, Consular Report of Birth Abroad (CRBA), issued by a U.S. Embassy or U.S. Consulate; 
    •  A copy of your unexpired U.S. passport; 
    • An original statement from a U.S. consular officer verifying you are a U.S. citizen with a valid passport; or
    • A copy of the front and back of your Permanent Resident Card (also known as a Green Card or a Form I-551).

It makes sense that if the back is blank all you are doing is sending a blank sheet of paper.  So if there is something on the back, you should send a copy of it.

Also since you ALREADY sent the info,  it doesnt change just because there is a new passport.  Dont send more. It wont make it to your file unless specifically asked for.
