That is overly optimistic as it is taking around  2 months for NVC to open the case, 2 to 9 months to get the interview,  the unknown is how quickly the applicant submits the required documents to reach DQ status

Its a throwdown estimate.  Takes how long it takes

Yes of corse but i 94 showing 44 days :) i think is automatic ?

You didn't accrue unlawful presence; there isn't a time bar because 0 days is less than 180 days.

Take the I-485 receipt notice to the interview. You can also print out 9 FAM 302.11-3(B)(1)b: https://fam.state.gov/FAM/09FAM/09FAM030211.html "DHS has interpreted "period of stay authorized by the Secretary of Homeland Security," as used in this context, to include:" "For aliens who have properly filed an application for adjustment of status to that of a lawful permanent resident (LPR), the entire period of the pendency of the application, even if the application is subsequently denied or abandoned, provided the alien (unless seeking to adjust status under NACARA or HRIFA) did not file for adjustment "defensively" (i.e., after deportation proceedings had already been initiated)"

Overstay 52 days no need Waiver ?

No waiver. There is no ban for an overstay under 180 days. As others have said you technically have no overstay at all since you filed for AOS while there
