i 751 pending joint and filing separation

Timeline

good evening  i filed since February  2019 i did my bio metric everything went well 

i have all evidence bonafide marriage i have even the miscarriage record of my wife and all document of our lives together we been married for 4 years 

but now we separated and i am planning to file divorce if no possibility of reconciliation 

can i file for citizenship while i  have a pending i 751 

 

if i am called interview can i go by myself because i have all evidence of her cheating lies and abused and threatened that trump gonna get me .

i still have those emotional hurts i am still leaving with 

  what happening at vermint after my biomteric its been 187 days no updates 

thats very slow center .

i am not stressing out about  any outcome because i have justifications and saved on record all evidence .

If you go to the interview then you can switch to a divorce waiver. Since you are separated you can do that already now. 

 

Forgot all that stuff you want to bring to the interview it will not help you. Instead you should focus on collecting more evidence from your marriage you should have more from you filed til now. 

 

No no you can not file for USC as you will be getting a divorce you will not be able to file under 3 year rule but will have to wait for the 5 year rule.

You can only file citizenship after 3 years if you're still married at the time of your N-400 approval and they can not approve or deny your I-751 without the divorce decree if you switch to divorce waiver.

The only people I've seen who were separated and were approved were those who were trying to fix the marriage. They had their spouse there and they worked together to explain it's been a rocky road, but they were in the process of fixing things.

There is no "We're separated, and we know it won't work out, but I just haven't filed for divorce" approval.


They won't care why you are separated, they want to see that your marriage was bonafide during the time it was happening. To them you are either married, married while currently in divorce proceedings, or divorced.

Go ahead and switch to a divorce waiver and file for divorce. There's no point in waiting.
