i-751 Taking too LONG

Hello Everyone, 

I filled my ROC on FEB/20/2018 then got extensions few months after. I then recently did my Biometric on  JULY/08/2019. The Status website says "we are processing the fingerprints for your Form I-751, Petition to Remove Conditions on Residence, Receipt Number W***************, at our California Service Center location." 

It has been like this till today. Please Assist
Anybody with a similar timeline. Please assist

Nothing to do...you're well within normal timelines. Some people are 18-24+ months waiting.

Ah, sorry. I misread that as 2019 (or did it say 2019 before? idk).

 

Feb. 2018 is still not that uncommon to not hear anything back yet. It is a little longer than average, but not out of normal processing timelines according to USCIS:

Receipt date for inquiry: January 28, 2018.

 

If the above date goes past your receipt date (it updates about once a month), then you can submit a case inquiry with USCIS. No promises it will do anything...but until it passes that date, you're considered in normal processing timelines.

Did you try calling and asking for second level of customer service? Those are immigration officers and let them know you would like to find out why this is taking longer than expected. Calling won’t hurt, so try it if you haven’t. And if nothing gets resolved until your receipt date shows up online, just submit an inquiry as soon as it does.

1/26/2015 - Case suspended - RFE sent out

2/3/2015 - Fingerprint done at Jamaica Center, Queens

2/11/2015 - RFE received - Case resumed

3/2/2015 - EAD ordered

3/13/2015- EAD card mailed out -- received it 3 days later

7/8/2015 - AOS interview ready to be scheduled for an interview

9/27/2015 - AOS Interview scheduled for Nov 3

11/3/2015 - AOS interview

12/11/2015 - APPROVED!!!

10/3/2017 - Sent out ROC package to VSC

The same here, I filed in Feb 2018, then I filled for N-400 in Jan 2019. I got interview In June 2019. then nothing for almost 3 months. I called them they didn't give me any reasonable answer.

That would be unnerving at best, good luck and I admire your patience

Filed at VSC, I filed in Feb 2018, did biometric in May 2018, extension letter August 2018, case transfer to NBC to be scheduled for interview letter received in August 26 2019, still waiting for the interview appointment letter. No Ref. 

 

Am having a sleepless night, nervous and crazy, I have not filed for n400 yet. 

 

Why interview. I don’t like any interview in my life. Have seen just few people got interviewed. Why me.

 

The painful part is, my mom is very sick and I have not seen her in 2 years, so we plan to buy our tickets in October to visit her in December. Thinking i751 will be over by September. What a bad luck. Am going crazy right now.

I disagree. I think you should adopt a more "vigorous" posture. Those processing timelines are practically useless, except to give cover to USCIS' inefficiency. You've waited long enough.

 

@geowrian is right in suggesting that if you submit a routine case inquiry, USCIS will say the case is within normal processing time. What you need is to force USCIS' hands:

 

- Call and ask to speak with a tier 2 officer

- Contact your Congressional rep for case assistance. You need to argue, though, that you've suffered, or are likely to suffer, harm because of the delay. Like repeated secondary screening at ports of entry, or inability to transit through some countries.

- If you so desire, and are eligible, apply for citizenship. This is your greatest leverage, as USCIS must decide the ROC before approving your citizenship.

I see your point, but there really is nothing one can do. A tier 2 doesn't adjudicate the case and unless there is a basis for an expedite, there's no action top take. Contacting a congressperson for a delay when it's within the same timelines as typical filers (according solely to USCIS) is just going to get back the same result IMO.

But I guess we can agree to disagree. :)

 

Filing for citizenship, if eligible, is certainly one good option we both agree on, though. 👍

 

Edit: Thinking back, the first paragraph may have come off wrong. I just believe the reality is that time has shown over and over again that USCIS is not receptive to complaints, pleases, or threats when it comes to timelines. They have always moved solely at their own pace.

From my experience, you're incorrect on all counts. I applied for ROC in Jan 2018. Case was still pending by April 2019, when my N400 interview rolled by. A tier 2 officer gave me information about where my ROC was stuck. I gave that info, together with description of harm, to my rep. USCIS Vermont responded, and promised to adjudicate the ROC in 15 days. Case was approved on the 15th day.

Different circumstances: N-400 interview passed (this is a big one), different service center w/ different current timelines, etc. Very weird that anybody promised a 15 day turnaround, let alone not the person who actually adjudicates it.
