Recommendation needed !

Hi ! I'm new here, I'm from Ghana and my fiance is in the US , we will like to figure out what visa will be the possible best for us to apply for?  , will it be the k1 visa or the spouse visa?  Thank you !

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
    Slightly faster arrival in the US 
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
    Spouse can not work until she/he receives EAD (approx 5-6 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

  

CR-1
    Slightly slower arrival in the US 

    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

Whichever route you and your fiance take, be aware that it is extremely beneficial to have several visits........More time together is the best remedy red flags in the case....

That's a question that no one can say with any certainty. It's a little faster for K-1 on the front end, but faster for the CR-1 on the backend (AOS stage) where the CR-1 couple get the GC and then are able to work within weeks of arriving. Whereas the K-1 must wait for the EAD authorization (work permit) and their GC.

No........time actually spent together is very important.   How many times have you actually been together?

Easy . . . If you are married it is the spousal.   If you are not it is the K1.

 

Either one, the more face to face time the better.
