AOS interview - Officer said they couldn't make decision yet because they couldn't find my original K1 files

I've finished my AOS interview earlier this week, and I think the interview went on well, but in the end our interview officer said, they couldn't find my original K1 file, it got split up with my AOS file so they couldn't make any decision yet, they'll request my K1 file send back to the local USCIS and then they would make decision, and will let us know if there's questions.

 

Has anybody met this kind of situation? How long does it usually take? I'm a bit afraid that they lost my original K1 documents...

I-485/765/131:

06/01/2018 - Sent AOS/EAD/AP through UPS, received NOA1 on 6/11. Received bio appointment on 6/15 and completed on scheduled date 6/29.

07/06/2018 - Submitted EAD expedite request with job offer, reason was financial loss. Received EAD/AP combo card on 08/04. AOS changed to 'Case is ready to be scheduled for an interview' on 7/24.

07/23/2019 - AOS interview was scheduled on 8/27. In the interview USCIS can't make decision because original K1 file got split up somewhere.

11/25/2019 - AOS got approved, received the actual card in mail on 12/2.

I-751:

09/05/2021 - Sent ROC through FedEx, delivered on 9/7, received message e-notification on 9/9 stated case was received, check is cashed on 9/10, NOA1 in mailbox on 9/13.

10/28/2021 - Fingerprints have been taken (Reuse).

01/17/2023 -  Case was transferred To Another Office

01/26/2023 - Case Was Approved

N-400:

08/28/2022 - Submitted N-400 online, NOA1 on 08/29/2022, with estimate time 10 months for decision. Biometrics is reused.

11/23/2022 - Interview was scheduled on 1/11/2023, it was a combo interview for I751/N400. Both cases were verbally approved. System hasn't been updated yet. 

01/26/2023 - Form N-400 recommended to be approved --> Oath Ceremony Will Be Scheduled

02/06/2023 -  Oath Ceremony Notice Was Mailed, Oath on 2/22

02/22/2023 - Oath Ceremony, applied passport the same day, with estimated receiving date in middle of May. ALL DONE!!

I-485/765/131:

Take it easy...... I would doubt that much gets done at many Federal agencies during the last 3-day holiday of the summer. B-)

 

The IOs likely have a whole menu of stalling or delaying statements, to keep the folks on edge and in the dark. There is no need to get all up tight about it yet. Maybe they indeed split up your file and now have to get it beck together again....Who knows???

 

At our AOS interview several years ago the week of Thanksgiving. We had our interview on that Monday or Tuesday. After a rather contentious interview, the IO said that he only gotten our file 10 minutes before the interview, so that he couldn't tell us whether we were approved or not, or whether he needed for information. He said he would contact us in 10-14 days, if I remember correctly. We were devastated !!! However, within a couple of house the text messages from USCIS were peppering my phone.....app approved, then card in production, then approved again, then under review.... It flip-flopped for a couple of hours. We finally decided to take 2 out 3 responses and call it good...we were approved....Thank the Lord above.

 

Your time will come. You will soon get your GC, and enjoy your 18 month respite from USCIS.

 

A tip for use in the future. Get a shoe box, or a filing cabinet drawer, set it aside for "marriage bonafides," that is USCIS-speak for what you will need for the next step in your journey, the ROC phase. Anytime you start a joint account, joint beneficiary, joint ownership, joint holiday cards received, joint invitations, etc., just throw any of that kind of stuff in the box or drawer. When the time comes, go through the box/drawer and see what you can use as joint evidence. It is far easier to do this, than to start scrambling around later on looking for this type of evidence.

 

BTW, your interviewing embassy is listed as Armenia. Is that correct?

One of my friends that went through the GC interview, IO said the similar thing as: I couldn’t tell you if I approve or not I have to talk with my manager, could be a few days/weeks etc., and 1 hour later their case got approved... Feel like that’s IO’s standard saying...

 

And thanks for the tips as well, we’ve been doing similar things, keep those documents at the same place.

 

I’m not from Armenia, I guess when I updated the timeline and the country column got messed up.

A missing K1 file during AOS interview is not that odd.

 

Generally, the interviewing officer makes a request to retrieve the file wherever it is located. Depending on the location, it can delay the approval from a few weeks to a few months. 

 

If you're too concerned, you can call customer service, ask for a tier 2 and inquire regarding your file. They will let you know if it already reached your local office.

Actually I’ve searched a bit in VISA journey and google, didn’t find anything similar to my situation, that’s why I’m worried. But good call on calling customer service, I’ll probably wait for a month or so and then call to check on the status.

There are a few cases around the forum -ours included-. Also there are many official reports on the matter from audits performed to the USCIS.

We were actually told by various immigration officers that it is quite common.

Had a similar situation at my AOS. The IO said after the interview that everything went well but she had a bad news. She didn't receive my medical and my K1 file so she needs to request it. It took 3 weeks after the interview to get the approval. Glad they found my file.... Ahh she said it would take a week tops to receive the files from storage or something similar...

Good to know, when I search I couldn't find anything, guess I probably used the not proper key words then. And thanks I hope mine get approved soon too!

Ahhh lucky you! 3 weeks is actually not too bad, I was afraid of 3 months lol... When we asked the IO, he said like could be a few days, weeks, months, and my face was like this 💀 ...

Alright just a quick update hopefully it would be helpful for future who is wondering the same thing:

 

Finally greencard got approved, it took them almost 3 months to figure out where did my K1 files go, but result is still good. Also thanks everyone for the inputs!

I-485/765/131:
