Hi all. I just checked the Guides link to see if we should do a K1 or a K3. But hearing advice from people already going through this sure would be nice...

Situation:

Me = born and raised in California.

My GF = born and raised in Canada.

We decided a little while ago that we want to get married. We are looking into the fastest route to get her here. Neither of us have a criminal record, no weird issues.

Is the K1 really faster than the K3? Is it true the "average" turn-around time from application submission to approval is 9 months?

If we decide to do the K3, is it better to get married in the U.S. or in Canada? What are the pros/cons for both?

Thank you very much to anybody who might have some advice.

From everything I have read, The K-1 is the way to go. Less time and paperwork. Good luck to you both.

From everything I have read, The K-1 is the way to go. Less time and paperwork. Good luck to you both.

All depends what the OP's looking for though, and whether speed is the most important factor... the Guides offer a pretty good comparison (and the CR-1/IR-1 route is worth reading up on... probably not the way to go if speed is all-important, but means MUCH less paperwork once the beneficiary arrives in the US, as they get their green card straight away)... we went for the K-1, but just wanted to point out that it's clearly not 'the' definitive route for everyone, or this site would have no need for the K-3 or IR-1/CR-1 forums! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

K1 average of 6 months until processed

K3 takes longer than that ,usuallyup to a year on a lot of cases.

I myself would go for K1

If his Canadian fiancée lives in Ontario or east of Ontario, though, K1 or K3 takes quite a while to be scheduled for the interview in Montréal. Your original estimate of 9 months is most likely the case. 3 months for CSC, and 5+ months waiting for interview at Montréal. If you live in the Eastern US and file through Vermont, and she lives in Western Canada and will have her interview in Vancouver, then you're looking at more like 3-4 months total: 1 month at VSC, and 2-3 months for Vancouver interview.

Think about it... If all things are equal (ie.... processing times, interview wait times, etc...) then K-1 will be faster because you can file that petition TODAY instead of having to wait until after having a marriage ceremony.

Thank you all so much for the advice/well-wishes so far! We were (and even more so now) leaning towards the K1.

Featherb - I think we're going for speed at this point, mainly because we're so sick of being apart! I'm sure many of you can relate. :yes:

Just something to keep in mind ... with a k1, you will have to wait 3 months for Advance Parole to leave the country (if your girlfriend wants to come back to Canada to visit family .. or if there are children involved) ... with a K3 .. you would not have to wait.

For me it was a matter of I HATE being away from my boyfriend - imagine your husband :crying: .

K1 worked out for us and now my husband is here in the U.S. with me!!

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
