CANADIAN VISA

Hi everyone, my husband is has a conference in Canada and needs to apply for a visa to Canada. He was told by his colleagues that the visa might not be approved because the US shares same database with Canada and also because he has an ongoing petition with the USCIS. How true is this information please

He applies and finds out. I doubt the US-based petition will have any impact as it does nothing for him in Canada (it could be an issue for a US visa, though).

The fact that he has a pending petition does not automatically  mean a denial. With every non-immigrant visa, the applicant should be able to satisfy the CO that he/she will not enter the US with the intent to adjust status. A way to do this is to provide evidence of ties to your home country (job, mortgage etc.).

 

With a known immigrant application pending, you can imagine that this burden of proof will be looked at a little closer maybe. But again, it does not mean an automatic denial of a non-immigrant visa.
