Will I Be Banned For This? Need help!

Hello everyone, 

 

I am posting on these forums after 5 years. I applied for a K1 Visa back as a Fiance in 2013, but due to breakup I ended up not pursuing and abandoning the case back in 2014. It's been more than 5 years since i posted for K1. I don't know its status, whether it was denied or processed, however back in 2016 I received a random email from USCIS that there was an update to my case but without the Invoice number I am not able to access the update status. 

 

Since then I have developed a business in USA with a partner. I would like to visit USA to discuss expansion through B1 Visa. I am scared they will look at my previous abandonment in a negative light and think I might overstay/deny my visa.

 

Is there any way to found out whatever happened to my K1 status? So I don't end up lying on my case visa and getting banned for misrepresentation?

 

Any help will be deeply appreciated

18 November 2013 - NOA1 (4 days after sending package)

21 November 2013 - Recieved Text and E-mail with Case Number NOA1

25 November 2013 - Received NOA1 Hardcopy in Mail

25 November 2013 - Alien Registration Number Changed

14 January 2014 - NOA2 (54 days after NOA1)

17 January 2014 - USCIS Shipped to NVC

29th January 2014 - NVC Recieved and assigned Case #

4th February 2014 - Abu Dhabi Embassy Recieved our case and the status is now "READY" for interview

24th September 2014 - Interview date - FINGERS CROSSED!

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

The petition expired years ago.

They may or may not consider immigrant intent still, but given that it was so long ago, I'm doubtful it will have much (if any) impact.

You are still subject to INA 214(B) - immigrant intent - for a B-1...no way to know what they will decide until you apply and they make the decision. Good luck.

Hey Paul, thanks for the reply.

 

 

My Concern is that DS-160 forms ask question which will be contradictory for my case, such as "have you ever been rejected a US visa" If i answer No but then answer  Yes to "Have you ever applied for a US visa" I will be setting myself for a misrepresentation trap. 


I wish i could know my K1 Status if its denied or approved so i can answer truthfully to these contradictions in my case.

Did you fill out a DS-160 then?  If so, check Yes and you can explain at the interview if they ask.    If no they can still ask about the old case.

You can file a freedom of information request (FOIA) but that is mostly a waste of time.

It wasn’t clear to me from your first post how far your K1 progressed. If you never actually went for a K1 interview, you never applied for a visa and so were not rejected. If the question is “has anyone ever petitioned for you” (which is how I recall it being phrased, been a while since I applied for a B though) the answer is yes.

Only Petition was filed, but i think that's considered a visa right?

No. Filling in a ds160 and appearing for interview is you applying for a visa. Again, if the question is actually “have you ever been petitioned for a visa” the answer is yes.

The I-129F is a petition, not a visa. Answer the question on the DS-160 as asked and you’ll be fine. :)

I see that you got a case number back then, on ds160 they ask if sonebody gas fill out for you a petition with uscis your answer will be yes, and explain.

On the question if they have denued a visa your answer is no, because you didnt went to the consulate to get your k1 visa.

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.
