Need new Passport. Waiting for AOS.

Hello, 

My wife and I got married on the K1 Visa back in November of 2018. We filed for her AOS in January (already did the biometrics) and now we are just in the waiting game. My question is that her Brazilian passport will expire in November of this year. Are we safe to get her a new passport with the Brazilian consulate? They require her to send in her old passport I think. Is that going to effect the AOS in any negative way?

 

If she has to send in her passport and wait for the new one, what document does she need to cary to prove that she is here legally?

A valid I-797 receipt after filing an I-485 is evidence that a person has "authorized stay".......

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What forms of photo ID does she have besides her Brazilian passport?

 

Utah DL/ID card?

 

EAD/AP combo card?

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

If you apply for renewal in person, they usually give the new passport back same day. Not sure where you’re from and if there’s any Brazilian consulates near you.

Honestly, they asked us for our IDs, not Passport. maybe depends on the officer?  Unless the passport is your only form of ID. bring it regardless.

 

In the meantime, try to renew your passport, by expediting it if you have to...it shouldn't take more than couple of weeks, a month max. Im not sure if new passports will effect anything, but if they wanna see  the K1 visa in the old one and you probably should bring both passports to interview. we gave her both passport and EAD but she was mostly writing stuff down from the EAD card, she flipped through the passport but not sure what she was looking at.

Case is Ready to Be Scheduled for An Interview: 1/16/19

EAD/AP approval: 3/18/19

AOS Interview Appt: 6/4/19

AOS Interview: 7/10/19

AOS Approved: 7/23/19

GREEN CARD IN HAND: 7/26/19
