The documents that need to be transcribe (divorce papers, birth cert) do these have to be apostle or can they just be certified? 

what are documents need to be submitted? My fiance has a child and the father is not in the picture do we need to get the papers from him allowing the son to come to the US now during the filing process or can we submit later during the interview process?

Often during immigration processes, absent parents sometimes start feeling parental. You should obtain from the father a notarized statement from them,  authorizing the beneficiary to immigrate with the son to USA. A short and sweet note is all that is necessary. This statement will be necessary for the visa interview phase of the process at the interviewing embassy/consulate. If the statement is not produced, it is generally felt that the US government would not want to be party to an international child custody battle, and will likely deny the child's visa.

 

You should also check the VJ Regional forum for your interviewing embassy/consulate, sometimes there are more stringent requirements with regards to your inquiries.

If the child is under 16, noncustodial parental permission will be required by Kyiv

I agree with what the others have posted with regards to your fiance's child needing a notarized statement. This is (I'm sorry but it is  a broad statement) an international agreement that children can't be taken without the other parent's agreement and notarized authorization. Now, if like you say the parent has been absent and decides to play 'hardball', usually all that is necessary is a threat of child support  retroactive from when he left. Usually, (not always) they have 2nd thoughts and sign the paper.

With regards to translation of certificates, divorce papers etc. I personally transcribed/translated my fiance's 38 page Colombian divorce from Spanish to English. On top of the translation I wrote that I was fluent in both languages but that there are some nuances that get missed. However, I stated that I was able to maintain the integrity and intent of the document. I then signed and dated it. This was sent in with my I-129F and was accepted by the USCIS and the US Embassy in Bogota. Nothing was notarized or stamped. Only my signature. But as always, your mileage may vary.  Henceforth, I feel that my next job after I 'retire'  will be translating documents for Latino clients in the local court jurisdiction!
