DS 160 FORM

Hello,

 

My cousin who is in Canada on Student Visa, and he would like to apply for visitor visa (DS-160) to USA for vacation. Also, my mom has filled petition my cousin's father since they are brother and sister. petition still in process, it may take couple years. So there is question on DS-160 If any relative has filled petition, and petition was filled for my cousin's father not for him. How should he answer that question on DS-160.

Did they start the process with NVC? Is he already listed as a derivative child?

yes, he is listed as a derivative child. but he is already in canada, over 21 years old. No process has taken place at NVC

When we were i this situation back in the day i listed yes for myself, but no for my husband & kids as they were not the person for whom a petition was filed. I just assumed that is the correct way to do it, and we all got visas. They will know that your cousin's parent has a petition filed for her regardless what he fills in anyway (i know this from personal experience!)
