UK BASED US IMMIGRATION LAWYER

Hi, I have a slightly complicated case in that my wife is a US citizen and I work for a UK airline. I travel 2 or 3 times a month to the US on a C1 visa but also visit my wife on my time off using my B1 visa or ESTA.

i want to apply for my green card as I want to retire to the US within the next 5 years.

my concern is that during the application process, I need to continue travelling to the US as described above.

I feel that with these complications, I am best placed to apply from the UK and probably should use a professional service rather than trying to do it myself.

Does anyone have any recommendations ?

I see nothing so complicated that a service or attorney would be needed. Visiting spouses is legal during the process.   Every time  (even currently) you enter the US, you at risk for denial based on having strong ties to the US (spouse).  Spousal visas currently take about 12-16 months, on average, from filing to visa in hand.  Many, many people here on VJ complete the process without the use of a service.

If you have the money to spare why not? I don't see anything special about your case requiring an attorney, however there's a reason we have attorneys. Sometimes just for hand-holding and assurance ( or a false sense of assurance). You have to do what makes you comfortable

on that basis, would you agree that applying from the UK (my current home) would be the best option? If that is the case can you point me at the best forum/ thread to get me started?

How else do you think you can apply?

There is literally no other choice for you. Your need a spouse visa, that's it. There is nothing complicated about your case.

Every new pursuit can appear daunting that’s why I’m seeking advice on this forum. My biggest concern is that I am entering the US so regularly on my crew visa in addition to entering as a tourist (via global entry) I just want to be sure that I’m not doing anything that might jeopardise my application

You won't be jeopardizing your spousal visa application since you have immigrant intent.  However, having a spouse inside the US is always a risk to entering the US via a non-immigrant route.

You're probably at a slightly higher risk of having issues than most people simply due to the fact that you enter the US so frequently, but I don't see anything here that screams lawyer.

 

You actually have a long history of respecting visa rules and complying with the terms of your admissions, which weighs strongly in your favor.

True......But every entry increases the chance of meeting the one CBP officer who will reject his entry request due to immigrant intent...then, it's game over.  I'm just saying that the OP needs to be aware of the risk.

Agreed, and as I said also the increased visits presents an increased risk. There is a danger of 'getting inside ones head' though and seeming overtly nervous or evasive. Just answer the questions as you always have.

The bigger issue is the practicality of retiring on the US, not the Immigration issue.

Money solves many issues, usually those posting on this forum are not so fortunate, but there are exceptions.
