Hello VJ community,

 

Little background on my situation, I am adjusting from B2 visa, PD: January 8th 2018, EAD approved May 2018 and AOS interview done in June 2018.

I have filled for the renewal of EAD and I am covered with the extension until November 2019.

My petition I-130 has been approved in April 2019 but the I-485 is not approved yet, I was just sent a RFE  in late April for a new medical and just responded to it.

 

Now here is my situation, I just got laid off my job after being there for a year. The company is being bought out so they are letting go of th "newest"  employees trying to cut on budget. Thank God I had a severance package so we should be covered for the next 2 months.

1. Do I qualify for unemployment since I am not a permanent resident yet? I know I was paying for it every month on my check but since I am in an authorized stay but I am not sure if I can still benefit from those

2. I remember reading an article that said if a permanent resident claims some social benefit it could jeopardize your citizenship application or maybe in my case even my GC application and it could be denied (https://wjla.com/news/nation-world/immigrants-receiving-welfare-could-be-denied-citizenship-under-new-dhs-rule ) , was this law ever passed or is it already in effect? Are unemployment benefits part of it? I searched but could not find a definite answer on it

 I do plan on searching for a new job asap but I would like to weigh in all my options, since when I go apply for a new job I will have to show my expired EAD with the" 6 month extension "and some employers may not feel comfortable hiring somebody with no clear visibility of their status. Reason why I am  debatting if I should claim unemployment or not since I do not know how long it will take for USCIS to make a decision or to get the renewal of EAD.

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

Hopefully someone will correct me if I’m wrong, but I don’t believe that unemployment would be part of that.  I always assumed it was for means tested things like food stamps or healthcare.  

 

Unemployment is more of an insurance type program - something you pay into for the purpose of being able to use it, if needed.

I do not think collecting unemployment will affect your immigration. If you qualify will depend on whether or not you have earned enough and worked the amount of time previous to losing your job as per your state's requirements.
